Hi guys,

I wasn't sure if I need to post this in for sale/trade forum. Mod, if this is incorrect place to post, please remove/delete.

I am not sure if I am overreacting. I purchase a brand new tmobile smartphone from hardforum user about 3 weeks ago, but recently I found out that phone was under financed. Which means phone is under payment and if he/she stops the payment, my phone will also become blacklisted. Phone is currently working fine, but I am worried that it will stop working and seller won't response to my PM. I paid using google wallet. I am just not sure what to do. Any suggestions?

It's like brand new phone manufactured in 6/22/2015, so it doesn't make sense for him to sell it and paid off either. It would probably cost him more money like this.

well it kind of does make sense for a thief - get it financed, make a payment on it, then sell it for a lot more than what his first payment was. Disappear then profit (for him).

If they pay nothing for the phone up front, then sell it for $X and never make a payment... They just gained $X for a few minutes of work. That may be worth more to that person than damage to their credit. Not everyone makes rational financial decisions :eek:

Plus some people do this with rationale like "I just need quick cash, I'll keep paying the bill later and treat this like a loan..." then they basically never pay the bill because they made other bad decisions.

Unfortunately, I did paid a lot of money for it. I will wait for seller to respond for few days. I will share seller's original post he created if I don't hear from him.

This is so disheartening. He was very nice guy to deal with.
 
Of course he was nice. You paid him a butt-load of money for nothing. He can afford to be nice.

I will wait a little longer before I make any decision. He has hundred of positive feedback in heatware though.
 
How was the phone listed? Was there any mention of the above (balance on phone, unpaid balance, etc)? Or, did he say the phone was clear on the IMEI, and nothing else? I would DEFINATELY contact Google Wallet.. NOW. Plus, if you can get hold of Crosshairs, he can send a message to the seller and perhaps that will light a fire under his @$$.

I would like to know who the seller is myself. Perhaps I can avoid any deals with him in the future, if this is his response to selling on here! Hopefully, this is all an innocent misunderstanding.

Phone was listed as brand new and it was brand new when I received it. Seller had good heatware feedback so I didn't bother to check the imei. I already emailed crosshairs but not sure if he's going to send him a email. I won't share his user id yet but he has not been logged into hardforum over a week.
 
He also listed it like this:

"It is fully gsm unlocked!, and will work with any gsm carrier worldwide."

I would say that is advertising as not being in contract. An unlocked phone does not have a contract attached, or am I wrong? He had really good heat too. Maybe its just a mistake? Although if he did not respond, it is pretty shady. He logged in yesterday :( According to his heatware, he seems to do quite a few phone deals......
 
Technically if the phone was under contract, it isn't the sellers phone to sell anyway.

He was selling few more tmobile device that were brand new and I wonder who bought em. Their phone is probably also under payment (EIP) It was sold pretty fast.

I need to call google wallet and find out about it. I usually paid using paypal, but seller was accepting google wallet only.
 
Did you pay with a credit card on google wallet? Do a charge back.
 
Hope it goes well for you OP, this is why as a personal rule I dont touch T-Mo phones (havent for a long time ... and im a T-Mo customer...), unless I receive proof of purchase. Good luck with the charge back.

I got a PM today from the seller and he did admit that it was under EIP, but he's telling me that he explained this to me that it will be EIP. I have all of his PMs but he never mentioned anything about EIP or payment. He said that all his tmobile phones sold here are like this. I just replied back to him and asked if he swap my phone with non-payment phone. I'll update you guys again.

Me too. I won't buy or trade tmobile phone anymore after my experience with this seller. I will only buy or trade for non-carrier unlocked phones. Hopefully, seller will resolve my issue for me.
 
That's a leased phone, why the fuck is he fully admitting to selling something that doesn't even belong to him? Do a charge back immediately, and don't listen to any of his excuses. That's extremely shady shit.

Dude just say no. Don't swap your janky leased phone for another phone from someone who didn't respond to you for a week. Get your money back and move on, don't try to fix this with the current seller.

Yeesh, I wonder if his other buyers are aware that his phones are all under EIP.

Doesn't T-mobile not unlock phones until they are fully paid off?

And I am sorry, but if you are advertising an UNLOCKED phone from TMobile in your ad, then it should NOT be under any type of contract. Thats false advertising..... Seller should be banned from classifieds as far as I am concerned because that is shady as all hell.

I have tried to purchase phones before where the seller refuses to give me the MEID so I could check it on Verizon due to "security" reasons. Ok, then Ill pass on the sale and let the next guy take his chances. Sometimes, saving a few dollars is not worth the risk. Always ask for the phone MEID (or whatever your carrier uses to check if its clear) when buying online.

I agree with you. Phone was definitely bargain and cheaper than the retail price. I already sent pm to crosshairs about it.
 
I bought a lot of stuff in the past from him and never had issue. I always got a good deal too.

That may be true, but what the hell is his angle here? He leased two phones with (supposedly) his own credit, sold them as 'unlocked' phones for well under market value, and took a loss on them? Either his account was hacked, he needed a very quick $1000, or he tried pulling some really shady shit.
