How DARE Google show a picture of a lady sitting on her porch, in plain view of the public, with her cleavage showing! I'm glad those misogynistic bastards had to pay up!

Google invaded the privacy of a Montreal woman by showing her sitting outside of her house with “part of her breast exposed,” and must pay her compensation, a judge ruled this month. According to a 17-page decision, Maria Pia Grillo suffered shock and embarrassment when she looked up her house using Google Maps’ Street View feature in 2009 and discovered an image that shows her leaning forward and exposing cleavage.

the best part is her collegue recognize her from looking at her tits...... guess we found out who the office whore is !

But the judge also rejected Google’s “public place” defense and said people do not forfeit their privacy rights simply by being in a location others can see them. He ordered the company to pay Grillo $2,250 plus interest and an additional $159 in court costs.

Privacy buffs may also be interested to note that the court drew a contrast between the law in the United States, and its emphasis on free expression, versus what prevails in Canada and Quebec. The judge also elected to adopt a “European approach” to deciding what should count as “personal information.”

Europeans... They have public beaches where they get nekkid, but god forbid, a picture of them sitting out next to a public road... Shame on them and Canada.

Great with this precedent set we'll see dudes trying to "accidentally" have the Google car snap a pic of them so they can sue.

The fine isn't nearly high enough for the emotional trauma of the entire thing. Google needs to pay several billion dollars so it hurts them enough to get those creepy pervert street view cars off the roads. It's too bad the US is so far behind other nations in dealing with Google.

It's kind of weird around here sometimes. So everyone if paranoid about the NSA, spying, etc. but if I person just comes up to your house and takes a picture of you at your home in whatever position, then posting that on the Internet is a okay?

Sorry, you're out in public. There should be no expectation of privacy.

So when you're standing on your own property that's now out in public for anyone to freely take pictures? I doubt that's how most people would see it.

Google should sue you for using their name.

Except that's what the law is, if you're outside you do not have the expectation of privacy

On your front porch isn't "out in public".

To take someone's picture on their own property and publish it worldwide without their express permission is an invasion of privacy. If the police did it people would scream blue murder.

Of course when Google breaks laws it's OK, because Google. Google can shove their Streetview up their collective ass hole, I hope they ending swimming in so much shit over their world wide surveillance that they shut it down some day.

So does this mean in Canada you can sit naked on your front steps waving at kids that walk by on the sidewalk?

There is probably a good reason why the movie and commercial industry needs permission though, right?

Generally that comes up because they are directly profiting from your image. Hence why release forms at least in the US.

Funny how a paparazzi with a 9 million zoom lens can take a pictures of a celebrity on private property with their tits hanging out and have it published with no recourse against them.

But is Street View any different? Google is using those images to run a commercial service.

The basis of this case is pretty stupid. But in a way I hope it drives a change. With technology now days I don't see why multiple images at different times cannot be gathered and spliced together to provide a maps image that is absent any of the non static objects. People, cars, bikes, all the things that are only their temporarily could be removed making maps better and more clear.

You gotta be fuckin' blown away by how people's heads are wired these days. You would think that it would just be a matter of contacting the company to remove your image, but no. You have to get something out of it. You have to sue.

I hope she gets doxed.

Im not sure if you aware of this, but the citizenry can do things the police cant. LOTS of things, its called Liberty. Your argument is terrible and you should re-think the difference between citizen and government.

So when you sue someone for wrongdoing and some random person on the internet dislikes the fact that you were awarded legitimate damages, it'll be okay for you to get "doxed" too? Also, is this "doxing" thing suddenly the ultimate male aggressive way of getting revenge on women or is it just a gamer community thing that hasn't gotten out to wider society?

Do you even know if she tried to contact Google first or not?

i did not leave all records of my private data/calls/whatever on the roadside for the NSA to stroll up and grab them. and its not paranoia if they are actually collecting such data without cause (which they are).

im also not going to gripe about the fact that my car is clearly visible in two different cities on streetview, one at home and one a couple towns over while i just happened to be next to the google car as we were both driving down the same road. thems the breaks

it would sound to me like perhaps you have you're either trollin with some pretty weak bait or your world view could benefit from an adjustment.

Google is not a Canadian citizen, it is a corporation which is not capable of becoming a citizen of a country because it is not a human being. That's just silly, what the hell kind of fucked up dystopia would ever consider a corporate body a citizen?

All I'm saying is that I find it hard to believe that anyone that's worried about digital spying would be perfectly okay with being digitally recorded by whomever whenever on their on property. I mean if there's a stranger standing in front of your house taking and you see him taking pictures of you and your family, you're perfectly ok with that?

i will run naked in front of a google street view car and sue because my penor is visible.

Yet oddly enough the "Journal de Montreal" and "gigaom.com" got permission to show the pics of her and her jugs? Or are they going to get sued now for her emotional stress?

Not to mention why the hell does Google have to pay anything since the judge agreed that the emotional distress was not related? Does that mean everyone who can be seen in Street View in Canada can sue Google for 2,250 even if Google blurs them on request? Or is it only if you're wearing short shorts and a camel toe?

You are out in public. You are fair game.
