Apple’s False Advertising Claim Against Amazon Dismissed

A U.S. District Judge has dismissed Apple's claim of false advertisement against Amazon today. Apple declined to comment on the ruling.

“The court finds no support for the proposition that Amazon has expressly or impliedly communicated that its Appstore for Android possesses the characteristics and qualities that the public has come to expect from the Apple APP Store and/or Apple products,” Hamilton said. She ruled only on Amazon’s request to eliminate the false advertising claim.

Isn't most of what Apple does false advertising in a way? Calling everything they do "innovative" and "new" even though everything they've done so far was already done, pretty much.

I really don't WANT to ride the Apple hate train, but damn, they just make it so easy!

Im pretty sure Cisco did this in the past. Essentially just litigate your competition to death and you stay the king while all the younger, faster moving companies struggle in court and don't get their product out then eventually fail. Only problem is Cisco was against small time companies, Apple is against behemoths like Google, MS, Samsung and were successfull against the likes of Motorola, HTC etc.

When you price your products out of most of the market the only way you can compete with lower-priced products is to remove them from the market entirely.

Ask any analyst what Apple really is - they are an advertising company that just happens to sell tech products.

Amazon is the antithesis of Apple, so I'm not sure how someone could find them in anyway similar.

Amazon goes for mass volume at cutthroat prices, exercises virtually no censorship in reviews of their products, and tries to minimize legal involvements, pretty much the polar opposite of Apple's business strategy.
 
I'm waiting for their suit over iOS. I've worked in training systems for years and we always had an Instructor Operating Station around - IOS. Lets see Apple prove they coined iOS.
