Smart move on Apple's part. Frankly, I am surprised it took this long to pay the guy off and make the story go away.

It would seem that the missing iPhone prototype wasn't "priceless," after all. Apple has apparently reached an out-of-court settlement to keep a San Francisco man from suing the company over what his attorney -- and virtually everyone else -- called an "outrageous" warrantless search of the man's home, car and computer last summer by two Apple employees accompanied by four city police officers.
 
I hope he got something worth while because honestly this would of been a gem in court.
 
Considering he would have won the suit hands down I'm guessing the payoff was WELL worth it...lucky bastard...I want Apple to vandalize my shit now!
 
This poses an interesting question. If some guys were to show up on your doorstep would you assert your authority and demand to see identification and a warrant before allowing them in? Or would you chance being able to sue the pants off some corporation, let them in and then end up settling for enough money to retire on?

I would assert my authority any day of the week. If the "real" cops had searched his house after he consented this wouldn't have been a case.

Fortunately for this guy the men who actually searched his home were not police officers therefore no amount of consent provided mattered.

I would have never taken the settlement, even with lawyer fees you would make more suing the crap out of Apple for that.

No uniform, no badge, no warrant? I'd do more than just take a piss. I'd be calling 911 and tell them to send the coroner to pick up the body of a guy who tried to gain illegal entry into my home. I've no duty to retreat and the law authorizes me to use deadly force on any unwelcome guests.

If the people at the door couldn't produce a badge and a search warrant, and especially if the cops were not from my city, I'd be on the phone to 911 asking for a city officer code 3. At no time will non LEOs be searching my home.

It was an actual officer in uniform with a badge who beat the crap out of me and stepped on me after I was on the ground and he continued on in.

BTW I ended up settling out of court. Six figures wound up being less than $3k after all fees, experts, court cost were added up. 3.5 years of threats (jail, job loss, "random" traffic stops with K9s) and constant pressure of financial ruin. It was tough.

So I ask, a group of guys shows up at your door unexpected. Some of them have guns and are armed. They demand to be let in with references to police investigations. You make a stand? That is real decision time.

I hate that that happened to you, I truly do. But, and its a big BUT...even knowing that it happened to you, they would still have to hit me, step on me, and then get shot by me if they did not present me with a signed warrant prior to entering my home. Even in podunk Alabama, we have Castle Doctrine which allows me to defend my home and my person with deadly force...and I will. LEO`s have a sworn duty to uphold the laws of the land, I on the other hand have a sworn duty to uphold the laws of my personal domicile, and the #1 law is to not be trampled on by anyone at my residence!

I would rather die on feet than live on my knees...period! No "private citizen" can force their way into my home without first getting through 8 rounds of .45ACP....No LEO is getting passed the porch without a warrant...just cause you have a badge doesnt mean you are above the Laws that you were sworn to uphold...

And that is why any sort of settlement of that nature should be negotiated such that your fees and costs in bringing suit are paid separately and in addition to whatever your personal economic and non-economic damages are. Well, you live and learn for the next time you get smacked 'round the noggin with a maglite.

As long as they do not produce a warrant, they get told to piss off. if they get pushy, I assert my right to self defense and call 911. I keep an AR-15 close to the door btw. we have had fake cops do home invasions here, and the local police know it.

Uniformed officers get treated more politely, but still, I would not let one in without a warrant if possible. hard to justify lethal force when the police are the bad guys, thats some bad news there, and a very tough call. hate that for you man.
 
Been so long since the story first surfaced I thought Apple had swept it under the rug like all the other BS they've pulled. I hope the guy got a fat pay off,but I would have been happier if the Apple people and police involved had gotten jailed for flagrantly violating the law.
 
I'm not answering the door unless they call ahead or I can see plainly that they are real (marked vehicles) and have reason to be there. If they kick my door in without identifying themselves first, lead is flying, I don't care what uniform they wear.

Too many fake cop home invasions these days to do anything differently.

Part of me agree with you on this. Even though you "won" and was in the "right", you still lost and the "wrongdoer" won and lived happily ever after. Very hard to assert your "rights" when it can ruin your life or your family's.
Not sure what I would've done in your scenario. If there is a hell, I sure hope the people who do such things are on the list with a 1st class ticket.

Wow what a story, I feel for your burden and support your situation as its told.

How very true, I have always been told by lawyers etc that you should stand by your rights but not stand in front of them! Cause they do know things like this happen and there is little a person can do to stop them until after the fact... as mentioned even then there isn't much that can be done.

Stories like these are the reason why we cannot loosen laws for the law to ensure victims "feel" vindicated and justice served. Yes there are plenty of "smart" criminals that everyone knows is guilty and gets away on technicalities etc. Because as this example shows not everyone is as guilty as the arm of the law says they are...

True freedom costs a lot, in many different ways. I personally will gladly pay the price/risk of some criminals going free for the return of my (and every other person's) freedom to be upheld and protected.

Yup I am liberal, I believe the freedom of the innocent far outweighs the justice of the criminal. Any day of the week, I will always uphold that belief.

I know how unfair for some victims this may be, being in that position myself once. Seeing a criminal "almost" wiggle out of the justice system. In the end justice was served, but it was a long and scary time (family getting b-day cards from the criminal etc).

Though in the big picture, citizens freedoms are just more important in the big picture, unfortunately many Americans only think of whats in THEIR yard and not others.
 
Well Apple is a public company and I suppose if the settlement was large enough we would be able to find it some where in their audits if you looked hard enough.

The only problem is that real cops do occasionally kick in doors without warrants, either by mistake or other reason, and if you shoot them you've got the state mob after you. Cops will kill you and come up with a good reason for it later, it's happened before.
