They should have thrown the book at these hardened criminals. A year probation? What is to stop these guys from stealing stuff like lost children or misplaced trade secrets? Steve is probably spinning in his grave.

Two men pleaded no contest today to theft of lost property in a case involving last year's iPhone 4 prototype, which Apple claimed was so valuable that a price could not be placed on it. The men, who were accused of selling the device to gadget blog Gizmodo last year, were sentenced to one year of probation, 40 hours of public service, and a requirement that each pay $250 in restitution to Apple.
 
Don't think no contect or nolo pleads are accepted on serious charges like kidnapping, etc.

speaking of, Did anyone else notice the iphone 4S bombed and has nothing new? There is an app on android called Google Voice Search which does the same thing as Siri basically, on top of a (FREE) 3rd party app which is IDENTICALLY like Siri/iphone4S. It's called Vlingo and its on the android market online, 1+ year old and even used on the iphone as well now!

Siri is for using your voice to do things on your own phone, the Google voice search is for using the internet/calling with your voice.

It sounds like the outcome was fair. On one hand if punished more, Apple comes out sounding like a bully (big no-no to their reputation) and on the other hand they were obviously not criminal types but admitted what they did, so some punishment was called for.

I assume by "bombed" you mean the iPhone 4S sold out in pre-orders with over 1 million unit sold in the first 24 hour period of availability. I've never owned an iPhone (yet), but no need to use false information to prop up your own incorrect viewpoint.

There's actually an app on Android that does the same thing and it's free to boot, I'll have to look on my Droid to see what it was if I can ever get past the slider screen. (currently not using that phone)

There's more than just calling in Android's Voice Actions. Each recent version of Android has added at least one new command as well, I believe.

What about Guantanamo Bay detention camp? That would send a strong message to the world. In America, nobody fools with big companies.
 
As serious as the investigation was (sending armed men to kick in a journalist's doors in and rummage through his house), you'd think that this would be a capital case. Maybe next time the prosecutor should go for the gold and seek the death penalty.

Sucks for these two guys. I bet they didn't even know that someone had to be a sacrificial lamb for Apple's viral ad campaigns and they drew the short straw.

I bet Apple loves having SWAT teams and death squads at their beck and call.

The difference is, you can't ask Android's or WP7's voice command "is the weather going to get any worse today?" and have it respond with a useful answer. Siri can handle real questions, not just dictated commands.

The app I mentioned earlier is pretty much the same thing as Siri on Android. You can literally talk to it or ask general questions like " Where is the nearest bar?" " What is the meaning of life?" and what not. Trying to find what it was having trouble booting up my old Android

I find your faith in an 800MHz dual-core, 3.5", 640x960 res, 512MB (ram) smartphone that retails for $750 or 300 on contract... disturbing (especially at this point in the year).

With 1.5GHz dual-core, 4.5", 720x1280 res, 1GB (ram) out within the month the iphone 4s is a lame choice. Hell, there are phone already out that are better.

However, nothing will ever deter the sheeple from anything "new" apple offers. It just reinforces the belief that companies can get away with less, even if they lock the shit out of it.

eh? the 4S is $200 with contract at launch and will drop to $170 on 11/4. How is an Iphone locked compared to let's say an Android phone? You still have to root an Android phone to get tethering access. You can customize an IOS based phone via Winterboard and Cydia
 
But there is price on the phone, or Apple wouldn't have asked for the unlocked price in total restitution.

Another guy here overclocked his 2600k to 4.9 ghz. I guess his rig is better than yours.
 
I'm surprised they got anything other than a fine since it was not theft, it was lost and found and failure to return.

Apple cannot in any way claim the event damaged their business...it was so much free advertising they made billions on it.

In California, you can't keep lost property if there is the reasonable potential of finding the true owner. Someones cell phone falls out of their pocket and its got contact information etc. you can get in some trouble if you don't return it. Find a penny on the ground, or even a $100 bill, you're fine, since there's nothing you could do to find the owner.

Basically, the law requires that you make reasonable efforts where possible to return the item, and where it'd require more than reasonable effort, you're fine to keep the item.

It can be an infraction, a misdemeanor, or a felony, too, depending on how much the item is worth and other factors. 1 year and/or up to a $1000 fine is the misdemeanor penalty.

I don't justify their actions in any way. From what I recall the phone was wiped out remotely by Apple. Not too sure if this was prior to selling the iphone or after. Then again if you're selling a phone for 5 grand I'm pretty sure they knew what they had and who to contact. Keep in mind Gizmodo "supposedly" made an effort to return the phone to Apple (although their motives were questionable). Apple neither denied or admitted that the phone was their property. Although, how are you supposed to return somehing when the party in question does not admit or deny that its their property?

Not on all phones you don't, it really depends on the phone and carrier. On my 1 year old HTC Desire on US Cellular, all I have to do is either turn on the 3G Wi-Fi hotspot, or plug it in to my computer and change the USB connection to the tethering option to tether. No third party apps from the market needed.

And that is without needing to pay for the tethering "upgrade" that carriers rape people for. Though I personally do not use tethering enough to show a spike in usage that would throw up a red flag.

You haven't been paying attention to politics. The current administration doesn't send people to Guantanamo; they just assassinate them instead.

man i've never heard of that carrier till now. Good to know you can take advantge of Androids native tethering

I'm pretty sure the latest figures have it stagnant in the market and Androind kicking ass.

So...not bombed, just the usual. Fan boys trading in perfectly good iphone 4's so they can look cool to one another.

You're still just asking it to do a search of the internet. From what I understand about Siri is that it can interface with your phone - check your schedule, create a meeting and add attendees, etc. purely with voice requests. I don't think there's any Android app for that.

That app I'm referring to (I wish I could remember the application name; FML) could do just that. When Siri was still available in the App store we did some comparisons with my co-worker (he had an Iphone at the time and I had a droid 1). I'm trying to search through the mobile sub forum here on [H] and see if I mentioned it. Because it's a no go on booting my Droid to look at the application history. You're right though, Siri is now integrated with the 4S, prior to the buyout it was not.

Yeah, it totally could have been developed by McDonalds, or my friend Bob. There's no way they could have known.
 
this whole thing is so fucking stupid, if it happened to any other company no one would've even had a trial.
 
Besides Vlingo there is another Android App called Voice Actions. It works just like Siri and will talk back to you and answer questions. It works on top of the Google Voice actions and adds a lot to it. One called Eve, which is the female counterpart to Edwin. IMO it seemed to be rough around the edges, but had a nice voice to it.
