I'm the "lucky bastard" that got screwed by buying Engineering Sample CPUs...
So much with "super server, super cheap".
Payed $1700 for two used X5650 Engineering samples and one used motherboard.

Here are some key points for this transaction:

1. I have enough feedback so you wouldn't have to put me on hold for 5 days until the payment was cleared, so you could ship the package.
2. After waiting so long, you said that you finally shipped the package, but it took you one week to give me the tracking number (basically I received it the day before the package arrived). Of course I threatened with Paypal/refund, since I had to wait 5 + 7 days to receive a tracking number! Plus poor communication, your messages came 2-3 days apart. I always answered same day as far as I remember.
3. You were dishonest from the beginning by not specifying exactly what you are selling. One would understand that you are selling the retail version, which is not true.
4. The price was fair, if the CPUs were retail. For ES CPUs, it's a different story. I feel that I made a bad deal, after I waited two weeks, I received Engineering Samples, without warranty. This is not "blackmail" at all, as you say. I got screwed by receiving Engineering Sample CPUs and I want my money back! Either full refund, either you send me $200 refund ($100 per each CPU), which I believe it is VERY reasonable.

The Cpu was brand new too, and my system has some used parts bought from other people through [H]ere and Craigslist.

My ES was $250.
I don't see what is wrong with buying an ES unless you paid the same price as retail.

I've been looking for a 990x ES.
 
Uhhh, I may have built my first computer and am still a rookie when it comes to computers (have no idea how to overclock), but I've been running an i7-965ES since October and have had ZERO problems. The Cpu was brand new too, and my system has some used parts bought from other people through [H]ere and Craigslist.

My ES was $250.
I don't see what is wrong with buying an ES unless you paid the same price as retail.

I've been looking for a 990x ES.

The allow me to enlighten you. Engineering CPUs are not the same as retail CPUs. They are samples given out to engineers, system integrators, QVL technicians, and even hardware reviewers. These CPUs are first and foremost the property of Intel and it is a violation of the original agreement to sell the CPUs. Many people who have access to them take these free CPUs (which Intel often generously allows them to keep, or rather never asks for their return) and tries to turn a profit on them. Since these CPUs were free that amounts to a huge profit. However it is still wrong to sell them.
Engineering samples are often highly desirable because often they have unlocked multipliers depending on what version of the chip it is. In some cases these are early silicon and clock speeds, or even certain features do not work as they should. On retail motherboards there can be compatibility issues as well. Additionally any ES CPU has no warranty. Anyone who buys one essentially needs to keep it a secret that they've acquired the CPU in the first place. So you are on your own if anything happens to it. So paying anywhere near retail (much less a premium in some cases) for one of these CPUs is ludicrous and simply not a smart move.

Intel often descends like an angry god on resellers of ES CPUs. It's kind of fun to watch, but it sucks when they track the CPU down to the buyer. Sometimes Intel has been kind enough to swap out these CPUs for retail parts, but they don't have to. It's theirs and they can legally get it back anytime they wish.

I believe the problem was in the description which implies the processors are retail by posting retail prices but delivering engineering samples (no warranty too). The description fails to identify the hardware appropriately thus baiting some buyers.

Hmmm, would be nice if intel can swap mine out for a legit i7-965.

Perfect description of the whole process. It would be nice if there would be a "Sticky" thread about Engineering Samples and why they are being banned for sale here? (or maybe there is one somewhere but I didn't see it)

Well generally Intel recommends you take it back to where it was purchased and request a replacement from them. At this point I wouldn't bother. I'd just keep it and go on with life. Just realize that if you sell it, and Intel finds out about it, you may have a problem. When it comes to looking for a Core i7 990X ES, don't. Just get a retail / OEM processor. The only real advantage the ES chips have over their retail counterparts is an unlocked multiplier. Even the many of them don't have that either. All the Extreme Edition CPUs have unlocked multipliers so there is no point in finding an "ES" chip.
 
Yea, when I bought the cpu off CL, the guy thought it was an i7-960, I looked up the numbers on the cpu and found out it was a i7-965. I probably had it for a month before I finally put it into a rig. And was glad it actually worked.

If anything once I get tired of this, I want to use it for a future HTPC. Gaming on a 46'' would be crazy!

I had some family issues arise so I was unable to send him tracking information until late. It was However sent as he asked when he asked. I refused to send till the payment cleared as I suspected from his conversation that something was amiss. Payment cleared and I sent the next day.

He throws a tantrum over the tracking and wants a refund right after I sent the package. I again suspected he just wanted me to send so he could get the entire rig for free. Now that he cannot get it for free he has cleverly decided to complain about something that I was unaware of. The CPU's are ES according to him as I never actually checked. I have only to take his word for it now. You will forgive me if I think he's full of shit or simply has an ES unit which he will take pics of. So He paid less for the rig than I originally asked by a mile.... 1700 vs 2400. Additionally he agreed to pay shipping which he did not. Then I was hit with the paypal fees on the 1700 and now he wants an additional refund of $200 according to his e-mails but in the paypal dispute he asks for $300. So he's lied to you, lied to me and yet I have to eat an additional $300 or he will blackmail me by threatening to get me investigated by Intel. You will forgive my desire to strangle him through my screen. I would warn any of you from ever selling or trading with this guy ever again. He tell you one story while doing another. he will get his cash from me and I hope the CPU's blow up in his face.

So let me make a quick review of the whole story:

- Payment sent on the 14h (Thursday) and cleared the same day. I asked the seller to ship the package as soon as possible, as I needed the parts for my new build. He replied saying that I will have to wait until the money is withdrawn from Paypal to his bank account. He never mentioned that detailed before the transaction, and it's first time when someone is requesting something like this, and I've been dealing quite a number of times before. I said fine, as long as long as I receive it next week.
- Few days pass and I keep asking if the payment has been cleared. Finally he says that the package has been shipped, but he didn't provide any kind of tracking information. I keep requesting the tracking number and he invokes all kind of reasons. I'm patient, so I wait. I know that people are busy, they have other things to do in the meanwhile.
- Finally, after other few messages without answers or late answers (2-3 days delay), on Monday 25th he gave me the tracking number (Fedex 804255715022856)
- Next day (Tuesday 26th) I receive the package. I try to install the motherboard into a Lian-Li PC-V1110 case, but the system doesn't post at all. After struggling a several hours, trying various memory chips and power supplies, eventually the system starts (but I had to take the motherboard out of the case first.. that was weird).
- Two days later (Thursday 28th) I take the heatsinks out to clean-up everything before finishing installing the rig (the board and heatsinks were a bit dusty). This is when I found out that the CPUs were Engineering Samples and I messaged the seller about it, asking for full refund or partial refund.
- He replies next day which is Friday 29th, saying that the ES are as good as retails and he won't refund or anything like that. Then I opened the thread here:

asking advice from fellow [H] members. As result of the advices received here, I opened the Paypal claim and I requested partial refund of $300 from the original amount or full refund and I ship everything back. I requested $300 not $200 as I initially intended, as some users here suggested $200 might be too low considering that the CPUs don't have warranty and basically no resale value and possible issues with the law if I ever try to sell them.

He has the nerve to claim that he never knew these were Engineering Samples, when in fact these CPUs are installed with 3rd party heatsinks (Thermaltake). I guess the heatsinks installed themselves, without his intervention? And from the amount of dust on them it is clear that they ran for a couple of weeks at least, during which time he never bothered to see what kind of CPUs he is running? How did he buy the CPUs in the first place? I don't believe they came installed on the motherboard with heatsinks installed on top of them - like I bought them from him, and he never bothered checking them? That's bullshit, sorry, I don't buy it. And from his reply to my email in which I told him that I got ES-es and not retail CPUs, it is pretty clear that HE KNEW he was selling ES-es, he never even tried to deny that - until now. He just tried to convince me that the ES-es are as good as the retail, maybe even better, and I should not be asking for a refund, because actually I made a very good deal!
And regarding shipping, my offer was $1700 including shipping. That's just plain bullshit that I didn't pay for shipping.. lol.

YOU ARE FULL OF CRAP, DIVINESMACK! YOU DESERVE A DIVINE SLAP ON YOUR FACE, YOU LIAR AND DECEIVER!

- the only thing that seemed amiss was that you had to transfer the funds out of your Paypal before shipping...? really...? that right there would piss off just about every buyer on this board, you won't get any sympathy for this...

- he throws a tantrum over tracking...? what do you expect...? he has no HEAT info AND IT'S A $1,700 purchase, you weren't sending him a $5 dvd :rolleyes: , he probably threatened a refund to get your ass in gear shipping something that you should've already shipped and given a tracking number for, the number one red flag in most of the deals gone wrong on this forum is no tracking number or bogus tracking numbers...

- you sold something that you had in your possession (and by the way did not legally own), but didn't know what it was or where it came from...? at best that's unprofessional and at worst shady as hell, that is ALL on you, period, know what you're selling, you don't use cpu-z...? at best that is unbelievable and at worst it's complete and utter bullshit...

- he paid less for the rig by a mile...? more bullshit that doesn't look good for you, you asked $2,400 for the WHOLE SYSTEM, he only bought the two cpus and the motherboard, stop lying...

- now you're bringing shipping into this...? really...? a $1,700 deal and you're gonna bring $20 or so up as a difference maker somehow...? :rolleyes:
