Did this guy just say what I think he said? Please, read this and tell me if that is not in fact what this guy is saying.

"Plaintiff's claims, and those of the purported class, are barred by the fact that the alleged deceptive statements were such that no reasonable person in Plaintiff's position could have reasonably relied on or misunderstood Apple's statements as claims of fact," Apple said in its answer.

Whatever. Apple did an ad that appropriates to the seconds long time slot they are permitted, and then proceeded to place a number of phones to demo in the stores where you buy them.

Actually - and I hate to be the wet blanket here, cause you guys all look like you're having a ton of fun here - if anybody in this thread would stop and think about this before posting, no, Apple is not saying "no reasonable person would believe their ads." The quote itself refers to the line, "twice as fast for half the price," from the ad for the iPhone, and ostensibly claims that the lack of concreteness anywhere in the statement should prohibit any reasonable person from interpreting it as fact. For instance, how exactly do you define 'fast'? Is it the download speed, the speed of the processor, the speed of the RAM?

I mean, Jesus Christ people, I don't even own a Mac, nor do I care to; but this is goddamn institutionalized trolling.

I've been saying for awhile now that their ridiculous ads would come back to haunt them.

First they basically admit they were lying about the Anti-Virus claim, and now they basically admit that all their ads are lies.

All that's left is for the direct mention of competition to come back and haunt them... The sleeping giant known as Microsoft is a behemoth of a company and could quite easily run Apple into the ground.

Yeeeaaahhhh....apple is screwed after this. But it depends on how big it gets...if it just stays with wired.com then nothing will transpire...but if it moves to more mainstream media outlets...they are fuct.

Except that I seem to recall Remington losing a lawsuit for the "close as a blade or your money back" line. If the claim can't be tested or is subject to too many conditions, it is false advertising.

nice try at spinning it. when apple in their ad said "twice as fast" what do yo think they are referring to? a loaf of bread? a hammer? wouldnt it be logical to assume they are comparing the 3g to the old iphone? would not a reasonable person assume such watching the ad? think about it.

Apples ads over the years have always been borderline at best when it came to anything reasonably resembling the truth. Nice to see them have to finally stand up in court and try to explain. Even if only a tiny bit of it.

A non-moron would know that internet pages - namely and especially on a damn PHONE - don't ever load that super-snappy. EVER. With that said...

...if you want a cool touch-screen/internet browser/music player thingy, get the iTouch. If you want a phone, then get a damned phone, not the iPhone.

Actually are there any companies advertising the product, which ain't lying? :) Those miracle cosmetics, batteries lasting for ages and so on, and so on... I guess Apple is just powerleveling the art of lying in commercials :)

I'd say anyone believing in an advert and staing them as "facts" just got what deserved. But, who of us have not even once, not believe some commerial :)

Its simple. If Ford had a commercial for the 09 Mustang, and said it goes twice as fast, at half the price, and had a video of it doing insanely fast laps around a race track, its false advertisement if its not true. Doesn't matter if they were "constrained" by 30 seconds or not. Bullshit is bullshit, no matter what fruit is printed on it.

That is not false, because it doesn't make a factual claim. It's all 'spin.'

The hypothetical ad doesn't say, so it is just blowing smoke. You can't prove it, but you can't disprove it either.

This is the same principle being used when you see a bottle of ketchup or a can of shaving cream marked "30% more, free!" More than what? Last year's package? A competing brand? There is no factual claim, only a vague impression, so the statement cannot be proven false. This tactic arose partly as a way to get off the hook for false advertising, because if you leave the factual claim out, you don't have to worry as much about whether you'll get sued when your competitor changes their price, product size, etc. before your ad runs.
