I had a thread open looking for a Asus A8N-SLI Premium motherboard. I was sent a PM by Mysticcal saying that he had the board and backplate for sale. We agreed on a price and I got his personal info. I did a quick search on the forums to see if he was involved in any bad transactions since he had no heat. I PMed a couple people that had an open thread stating that in fact he was a troll - sorta. It was later straightened out between both parties but both buyers encouraged me that he should ship first.

I brought this up to Mysticcal and he agreed to ship first. We agreed on a price and shipping - USPS. I had asked him to ship it out on Thursday because I needed it soon and would like to get it before the July 4th holiday. Today he IMs me saying that some bills came up and he would like me to pay half. I told him we had a deal so he provided me with a tracking number from USPS (which came up as no record found).

When I told him we had a deal he said he would be going back to the post office to get the package and that our deal was off. I just want others be warned about this guy....get him to ship first because he's shady.

you shouldn't be mad because I cancelled a verbal agreement, it's my board and I choose whom I ship to.
 
I'm not mad.....I'll just buy it from someone else. I just wanted to make people aware of the stuff you try to pull.
 
I'm not trying to pull anything, all transactions between me and another buyer have either been shipped or refunded, I in on the other hand do not feel any way safe about shipping first and having no protection, I don't see why this is an issue as no transaction ever occured, I didn't pull anything shady as I do own the board, sent real legit pictures, hell, I even provided my personal info including my phone number. If anything, I'm just being too cautious
 
then how can you have a tracking number if you havent shipped it yet? was that just a lie to get money from me?
 
USPS updates all of their tracking numbers at midnight each day, it won't show accepted until the end of the day or midnight.
 
so if you didnt ship the package how can you possibly have a tracking number? that doesnt make any sense. you said you shipped it out today and then when i wouldnt give you the money you claimed that you were going back to the post office. i highly doubt the post office would give back a package as they would have no way to confirm it was you that shipped it. my guess is that you never shipped it in the first place. you were just trying to get some money out of me and probably scam me and possibly others.

again, there are 2 traders here that have had problems with you. that is the reason why i asked for you to ship first which you agreed upon. if you dont want to sell it and change your mind that is fine as well....but to turn around and back out of the deal because i wouldnt give you money upfront is kinda shady. esp after i went out and bought the missing accessories off ebay.....like i told you on IM....do what you want with it.

then why did you lie and tell me you shipped it out today? so not only did you not ship it out yesterday like we agreed upon but you didnt even ship it today. you are the definition of a troll. anyone that reads this just beware of this guy....he lies and renegs on deals. :mad:

so you dropped it off at the post office and then went back a couple hours later and got it back? that sounds HIGHLY unlikley.

first, im gonna say, everything after the Op should have been said in PMs, this post will be locked soon.

2nd. mysticcal, a verbal agreement is a binding contract, so you broke a contract, which happens to be illegal

3rd, in that quote above...as the OP said, the PO would not give you back the package. period.

4th. again, verbal agreement = binding contract, which you broke when you demanded any kind of payment before he got the item.

don't get me wrong, I am in no way biased towards the OP...but your story is just...well...sniff sniff.
 
Ok, we went over this, verbal agreements are nice and all

but has anyone ever gotten paypal from all the people that "said" they were going to buy the item? I don't see why this situation is any different

the main reason I went back (and they will give you it back if you show ID) is because the OP was being very harsh about it being out on thurs, while still trying to get the cheapest possible deal from me, I mean, if he wanted me to break from work and try and ship it out as soon as he pleased, then he should have paid me what I was asking and not what he wanted. shipping isn't cheap with priority, especially accross the country, I just didn't have anymore interest in the transaction.

Hes right acutally a tracking number can take up to 24 hours to show up, and he printed a label, and in my experiences it takes a long time to show up. I think you kinda jumped the gun calling him a troll, he didnt really do anything wrong i nthe shipping department, what he said is ture.

i dont know about other stuff, and breaking a agreement, thats bad yea, but it doesnt make him a troll automatically. The thread didnt really need to happen, pm could have sorted it out

not exactly bro. we had agreed on the deal Wednesday night. I had told you that I had another offer on the table for $10 more but I needed the board ASAP so I went with your deal minus all the accessories. I then went ahead and purchased a SLI bridge which you did not have and some other things off ebay. I IMed you at 6pm (EST) on Thursday and you said you would be going to the post office in a few hours. You then IM me today saying you shipped it out and some bills came up and you wanted half of the money now which was not part of the deal.

The deal was this: USPS priority shipping, $75 for a ASUS A8N-SLI Premium MB with only the backplate. I said since you were involved in a couple troll threads I would feel more comfortable with you shipping first which you agreed to it all. You reneged on the deal....and now I'm out $30 for all the accessories I had to buy - is that fair?

oh and verbal agreements are legal transactions....and so is mail fraud. having someone interested in something you are selling is different then agreeing on a transaction and you backing out. just close this thread im done with it....this guy is a troll and thats the end of it.

that blows, if he bought the stuff for it and you had an agreement, you should follow through on it it isnt fair to him and thats what you agreed on in the first place, its not his problem you had some bills come up.
 
I think the term mail fraud is used fairly heavily here.

A person can be found guilty of that offense only if all of the following facts are proved: First: That the person knowingly and willfully devised a scheme to defraud, or for obtaining money or property by means of false pretenses, representations or promises; and Second: That the person used the United States Postal Service by mailing, or by causing to be mailed, some matter or thing for the purpose of executing the scheme to defraud.

And I didn't mean interested in the item, I ment can I purchase the item? what is your paypal" kinda thing, not sure why this thread is still going on, It isn't my fault you made seperate purchases, and I don't see you trying to help resolve the deal but just point fingers at me, wouldn't you be more willing to resolve if you spent 30$ on accs?

so what you want to hold me hostage now because I spent $30 on getting all the accessories to the board? fat chance in hell on that one bro. my worst case scenario here is I just buy it OEM from newegg for $70

and yes, mail fraud....you provided me a tracking number for my package. when i dont get my package that is connected with that tracking number then we will have a problem....care to continue this further?

never spent $800 on a graphics card, sorry. own up and agree to the deal....the faster u ship it the faster u'll get ur money. i have 100% feedback on both heat and ebay. if i dont send u the money as soon as I get the board then u can follow up on our little thread....but as it stands u look like the bad guy.

Dude he didn't troll you, christ give it up. Did he steal your money and never send you the product? No, he may have backed out for finacial reasons or whatever it is, thats up to him, but you can alwasy get it from someone else so i dont know why you keep trying to destroy him calling him a troll, its stupid and your making yourself look like a little kid. You could have taken it to a PM i nthe first place, as he never trolled you. No money or item was ever sent, he didnt troll you, period. even though he shouldnt have backed out, your takin it a little over the edge, until he actually trolls someone, as fishy as it seems that he wanted to back out once he had to ship first, he didnt really troll you, so hes not a troll man.

And alkoholik, people back out of deals lots of times, it happens to everyone and lots of people have done it, Obviously a thread wasnt created every time this happens, most people go on with life, which you seem to have a problem with doing.
 
I think Mystical is wrong in negating an agreement. Also, I don't think it was verbal as the medium was PMs, which would be a modified written contract (ie, contracts made over emails between two firms). Unless, the OP and Mystical spoke and agreed over the phone or over a conversation, then it would be a verbal. Even then, I am pretty sure that the court systems are less lenient about breaking even verbal contracts.
However, since there was no actual loss of money, the OP should not freak out over it. There is no trolling here, just very questionable selling practices and/or trustworthiness issues which can serve as deterrent for others (myself included).

when I'm out $30 for buying all the accessories then its a loss for me. we agreed on the deal and I went ahead and bought a sli bridge, (2) sets of sata cables, the external usb card, etc etc....so how can u say i didnt lose any money? now i got all this crap laying around here with no board to connect it to.

like i said before.....this guy has had problems in the past with 2 other sellers aside from me (there is an open post about that as well) and that is the only reason I wanted him to ship first. once I got the thing I would have gladly sent the money paypal ASAP. so once again becareful when u deal with this guy.
 
HE DIDNT TAKE YOUR MONEY... how hard is that for you to understand, and you can buy the board from someone else? i see them like everyday on multiple forums for sale. So your not really out of anything. He didnt troll you, period. so stop freaking out and go on with life? if that is a possibility. Buy it from someone else... he isnt the only person that has one for sale.
 
This whole thing should have been handled via PMs. Both have records for being a problem here, so both are gone.
