Deviation said:It's already been said, but I'll repeat it: Boo-fucking-hoo. I absolutely applaud their decision to cut people who they thought would resell the mechandise. I'll bet that if you said you'd drop your order from 5 to 1 so you could just have one for yourself, they would have put you back on the list and you'd get one at launch. Heck, with $250 down, you're only $150 off from a premium bundle.

matt fury said:It doesn't matter if the OP wanted the systems so that he could smother them in vaseline and try to shove them up his ass. They made a deal with him. He would give them $50 per system and they would, in exchange, sell him a system on the first day it came out. That's it. Now, they clearly didn't explicitly state that, and that's why there isn't much of a legal case here, so that's besides the point. You think EB didn't know that supplies were going to be limited when the system came out? Of fucking course they did. That's the damn reason they use to try to get you to buy a preorder. So when they're doing that shit, they better A) Have a foolproof plan to get enough systems to cover pre-orders B.) Tell the customers that they aren't guarenteed one on the first day, and/or C) Be ready to make reparations to some pwned customers. And from the look of it, they've done ZERO of the above.
I own a game store. I don't do video games, but it's all the same shit. I don't take a pre-order from someone if I don't know with a reasonable certainty that I'm going to be able to fill that pre-order right away. And if all the plans go awry and the pre-ordered items don't come, then guess what, I eat shit and offer my customer something in exchange for the fact that we made a deal that I couldn't complete. Sure, I technically might not be the reason why I couldn't get the product, but the fact is I promised them said product anyway. And believe me, no matter how much it might suck to offer to one customer instead of another, it's FIRST COME, FIRST SERVED. Not biggest order gets the most priority. But whatever, I guess that's why EB is huge and I ain't shit.

Pricing and promotions on EBgames.com may vary from that of Electronics Boutique, EB Games and EBX stores.
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. EB Games reserves the right at any time after receipt of your order to accept or decline your order for any reason. EB Games reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. We may require additional verification or information before accepting any order.

Kevin Lowe said:S-F: that sort of language is usually there to cover errors on the website - when Amazon offers something for $19.99 instead of $199.99, for example. I'm sure the brick-and-mortar EBs have a preorder policy that allows them to do what they're doing, but this isn't it.

So EB games may not have fullfilled their pre-order obligation, but we are going to try to make the idea work anyway. I've been drawing up the plans tonight - getting the mapquest route figured out and setting up our itenarary. It'll be fun anyway, and with the stores I've picked out in the shady neighborhoods I think we'll not even have to end up waiting in line long. Hitting a midnight opening, then a 7:00, 8:00, 9:00, and 10:00 opening all of different stores. Then list them in a one to three day auction on ebay and I've easily paid for my own unit.
