The court ruled that orientation is a protected class, and that is what Bethesda is basing their Code of Conduct on, and specifically mentions sexual orientation (amongst others) within that CoC.
 
The irony of people coming into this thread complaining about people getting upset too easily, yet they're complaining because some homophobic trolls got banned from a video game for their actions. I mean, unless I've missed part of the story, the victims aren't demanding millions in compensation from Bethesda and starting protest marches here. Some small minded idiots acted like dicks and were given a proportionate punishment. Where the fuck is the controversy here?

It's that the asshattery leading to the permaban was not at a level worthy of such a ban. If it were not for the protected group element attached to it, a 3 day suspension, if even that much, would likely have been considered appropriate by Bethesda. Since it was one of those special groups, you know, the one's that need to be protected like newborns for some reason, the asshat got a permaban.

Give the guy his money back and I am fine with this, otherwise, I really think Bethesda went to far. It's not like they could not block the guy and never have to deal with him again. His asshattery is no more grievous than the guy that destroyed my camp for shits and giggles.

Secondly, being banned from a video game is the penalty. That's it. It's a perfect punishment as it means other, more normal, people have one less troll to deal with and it's in the best interests of Bethesda to get rid of them. We're not exactly talking jail time or fines.

The snowflake victims should also never play Rust. I lasted about 10 minutes and 3 deaths before giving up on that game. Ran my own server months later to learn it.
 
Bethesda may owe all the players of this title refunds, but none due to this incident.

All the parties involved acted fine, post incident.

A player reported offensive conduct that violated the TOS and showed proof.

Bethesda investigated and took action based on their TOS.

The offending player owned their actions and accepts their consequences.


And the whole story made me lol.

There was no cheating, or hacking their servers, or stealing accounts or anything like that. This was an overreaction by Bethesda's to a simple case of griefing. So yeah, I think it fair they should get their money back.

Firstly, they do not deserve protected status anymore than an (R) that is hounded out of a restaurant, or their family harassed in their home, because of their religious or political beliefs does. I quite simply do not believe in protected groups based on race, religion, political beliefs, sexual orientation, sex, or gender.

Secondly, this was an excessive penalty in my opinion. One not in line with the punishments for griefing I have witnessed over the last couple decades of online play.

Your opinion of who is or is not the snowflake in this situation is noted. My opinion differs, but you are welcome to your opinion. It is a freeish country after all.

In theory yes as they should be (equality under the law) but the change in the law was pushed by a gay state senator because gay people were upset they couldn't donate blood after the Orlando night club shooting.

I don't know enough about that law to make a judgement one way or the other. On the surface I don't think it's fair, but I also don't know the hows or whys of it.

Even if that's one example of a beneficial law though, it doesn't change the fact that the group is persecuted.

That's enough of the off topic though, the reality is that this entire thing shouldn't even be a story. It's just some small minded trolls who got a slap on the wrist. Bethesda did exactly what they should have done.

In any case, if such a minor tos violation deserves a permanban, and they are actually enforced uniformly, and not just based on sexual orientation of the "victims", the servers would be pretty empty. This behavior is not uncommon in Fallout 76. It is why I have proximity chat turned off. I thought everyone left it turned off.

This is so absurd. People being called names in an online game has been going on since games have included online play. I was called all kinds of things when I used to own fools in Counter-Strike with grenade headshots. Why do people always feel the need to bring emotion into a video game where the point of the game is to kill others in a PvP environment? The point of the game is to put aside any feelings you might have for your fellow man in order to survive if you can't handle having your feelings hurt how the hell are you going to deal with the emotions most humans would have to deal with if forced to kill another? There is a reason it's rated Mature, are people this offended when movies deal with Mature subject matter and are Rated R?

This was a group attack that was akin to a virtual lynching including reciting the history of the oppression towards a minority group.

There is a reason blackface is more offensive than just the makeup.

I just don't share that opinion. I don't find blackface offensive. I don't see gays, or POC as oppressed groups in this century. They deserve no additional protections over anyone else.
 
Let's see- They play a game where murder is acceptable, even encouraged, but, an opinion of anothers in game behavior is a problem? Because it may hurt their feelings that their lifestyle and/or real life "identity" is not condoned by others? Yes, it is sad.

For FO76 and this... Funny but whatever, they violated the TOS regardless of the targeted persons sexual orientation and in today’s view of no one should be offended I am not surprised they were banned.

Now coming from the days of tieing up a phone line to play doom, duke nuke and etc... games online... Either get thicker skin, leave public chat, or GTFO. While I don’t go out of my way to harass people, I also really do not care about your feelings and will not censor myself so you don’t feel bad.

Man the fuck up and find another area to look for beer bottles & toy trucks, Then when you're strong enough, give the other players that hurt your fragile little mind a taste of their own medicine. Use it as a tool, you dont ever get mad, you get even.

I guess you have to have lived thru the difficulty of some of the older games and the amount of swearing you end up doing when you are facing the final boss in a game and dying and not being able to continue at the boss but have to go all the way back to the beginning.
