If You Sue Pirates at Least Own the Movie Rights

This is probably the funniest case I have read about when it comes to getting sued for torrenting a movie, the one is question in this case is Fathers & Daughters (never heard of it). Now if you have ever been sued, there is nothing funny about it, as it costs you an arm and a leg, and sometimes your house too. Anyway, the gist of this is that the company suing this poor guy did not actually own any of the digital rights to the film anymore except "on airlines and ships." And since Zhang was not torrenting while he was actually in the process of traveling on a ship or a plane while said movie was being torrented, the case got kicked. I hope Mr Zhang gets his attorneys fees back.


A federal judge in Oregon has told a movie company targeting a local Internet user that it won't be able to sue him for alleged movie piracy via BitTorrent. Judge Michael H. Simon informed the company behind the 2015 drama film Fathers & Daughters that since it didn’t possess exclusive rights as required under the United States Copyright Act, it has no standing to bring a lawsuit.

Now they're suing for things they don't even own? Unbelievable.
Not really, I've defended a couple of copyright cases where I got them booted for lack of standing on copyright ownership, they only had non-exclusive licenses and their idiot attorneys thought that sufficed. It is difficult to get attorneys' fees though.
 
up here the penalty is so low and the burden of proof so high that suing infringers is wasteful.

just ask high voltage films.

I'm sure I'd be absolutely horrified at some of what goes on in civil (or for that matter, criminal) court. I guess ignorance is bliss...
