NY State Bans Vaping Indoors

In thirty days, the state of New York will ban the use of e-cigarettes indoors and near certain areas such as similar to how tobacco is treated. As part of the Clean Indoor Air Act, the measure seeks to provide a safer environment for everyone in restaurants, bars and workplaces. A recent study has suggested that vaping maybe just as harmful as tobacco cigarettes causing similar damage to DNA.

"E-cigarettes often contain toxic chemicals in addition to nicotine, something bystanders should not be forced to breathe," said state Sen. Kemp Hannon, a Republican from Garden City who sponsored the legislation. "With recent reports showing their use among minors increasing, New York must continue to work to regulate these devices in a common sense manner."
 
I'm not a smoker, and I don't really care that much if other people around me are so long as they aren't blowing it in my face.

I find BO and strong perfume/aftershave more offensive than vape smoke. They should ban that while they are at it.

Perfume doesn't cause lasting damage to a persons DNA, smoking does. Whether they blow it directly at you is irrelevant; it's in the air around you, so it's having an effect.
 
I've vaped both nicotine and THC (Oregon - legal), and no one near me would have ever had a problem with what I was doing, or even smelled it. Why? Because vaping doesn't have to produce a noxious cloud. Unfortunately, jerkfaces have to ruin it for everyone. "What? It's not smoke! It's vapor!"

Seriously, two quick hits off a decent vape cartridge should solve one's problem with either craving nicotine or wanting to be high, and there should be no noticeable cloud or smell in the air afterwards - if there is, you did it wrong...or you want the world to pay more attention to you.
 
See, if you're indoors the little cigalike and pen type vapes should be okay. They don't produce a lot of vapor. It's douchebags clouding places up that ruin it for the rest of us. I do enjoy using my bigger vape, but I take it outdoors and aim up where the cloud isn't gonna piss anyone off.

That said, banning smoking and vaping in places like bars is fucking stupid overall.

I have been vaping for 4 years now. No issues at all heck when I go to hospital sometimes they check my lungs and they say wow they sound great. That DNA thing and harmful thing is only when you have dry hits. Well guess what most devices now will not even allow it. They have temp control, and sensors inside to detect dry hits so they don't even fire. They banned them indoors here in NS canada as well. Sucks that if I want to vape I have to have them with the other smokers which I have to smell and breathe there second hand smoke makes me sick. BTW if you ever goto a concert and see those fog machines for stage and lighting its the same tech found in e-gigs. I wonder if there going to ban those as well.

How do you not produce a cloud when you exhale? Do you just aim your mouth down into your chest and slowly exhale with your lips pursed to shoot it out in an invisible stream or something?
 
I think vaping should be banned all together. Nasty nasty nasty. 300 dollar fine for the first offense and double for every offense after.
 
Usually after eating something with marinara sauce, I fart a lot. The fart is not dangerous if I don't fart too much. But I wonder if the people who vape around other people would like it if I let some rip once in a while around them. There's no cloud of vapor, nor anything in my fart that will harm them. I guess that's a no?
 
I'd expect nothing less from NY than passing knee-jerk legislation based on questionable "science". I'm sure CA either has or will soon do the same.
 
I don't really know much about the different types of vaping - but a guy in our office has this little thing that's no bigger than a pen. It produces literally zero smoke and no smell whatsoever. It's allowed him to finally quit cigarettes after decades of smoking.

I'm willing to bet that even if the whole country passes this law - people would still be able to use those devices and nobody would even know. They are so discrete - quite amazing actually...
 
Personally, I believe it should be the choice of the owner of the establishment. It is not a right to have a business conform to your liking. However, you do have to right to not do business with them if they do not conform to your liking and find one that does. I do not smoke or vape, but I do believe businesses should have the right to choose if they want to allow smoking or vaping. According to the CDC, in 2015 about 15.1% of the US population 18 years and older smokes cigarettes and 3.7% vapes regularly. So if a business wants to appeal to 18.7% of the adult population and potentially lose customers over it, that is their call.

Is someone forcing the non-smokers and health conscious to enter their establishment or conduct business with that company? If so, who?

I believe it is the responsibility of the employer to disclose such info. But it is the responsibility of the employee to choose whether or not he/ she is willing to work in such an environment. At every employer I have had, part of the hiring process is to read through and agree to the employee handbook/ company policies. And if it is disclosed in the handbook that this is an establishment that allows smoking, then it is the choice of the potential employee. If the employee chooses to work there and gets sick from it, then the employer should not have any liability. The employee agreed to work under those conditions. There are plenty of other jobs out there.
 
I always vape as if I am smoking, and follow the same rules. Anyone who doesn't is an asshole.

^Love this take on it. I was at kids birthday party this past weekend. Lot of kids 3-8 years old running around. We're inside getting ready to sing the birthday song and all the kids and parents are gathered around and some dick pulls out his vape and starts smoking. WTF? How about wait a bit or take it outside or even across the big ass room. As mentioned in another post, this was the douche bag guy blowing smoke all over the place.
 
the science behind vaping being "dangerous" is convoluted as hell to serve agendas, pretty sure all indoor actions that leave "scent" in the air be it the burning/cooking of things such as carbon from foods, grease and so forth probably are just as "dangerous" as vaping.

When I walk into a room where someone was/is vaping for days/months, I cannot smell a damn thing, so to say its the "same" as smoking is outright BS, it is NOT combusting the material and the "vapor" is a much larger particulate than it would be for many other things such as tobacco.

It is just convoluted science such as running ecigs at WAY higher watt/voltage allowing the device to dry fire etc and using the resulting data to brand them as dangerous...IMO folks just need to settle the fk down, plenty of things others do you do not like or appreciate, but it is THEIR life they have the right to live it how they see fit as do you (within reason of course cause we are supposed to be a "society")

yeh is a dick move for sure, at least ask first would only be fair, but it is NOT smoking folks need to get that out of their heads, smoking is combustion, vaping is not pure and simple, there is just as many nasty things in the air as vaping will ever do, at least vaping generally smells ok to yummy compared to the nasty chemicals given off by paints, carpets, general air quality, our food and so forth.

demonize things that deserve it IMO.
 
I can't help but notice strikingly similar behavior between the staunchest anti-vapers and the social justice warriors roaming about the internet of late. Just saying...
 
We have a few people at work who "quit smoking" and started vaping instead. They only vape on breaks in the official smoking area. When they come back from break, there is such a cloud of odor around them I literally begin to get sick. This is not everyone who vapes at work, just these few. As much as I detest the smell of cigarette smoke, I actually preferred it when these people smoked instead of vaped.
 
I'm glad you can still smoke in bars where I live. They tried to change it a few years back, but it was voted down by the public.
 
As I said before, the goal is to stigmatize vaping the same as traditional cigarettes, so they can justify slapping a huge sin tax on them. With more people quitting smoking, that fat revenue stream is drying up.

im not so sure about that. I "LOVE" those who bathe in the shit and you can smell them long before.. and after they are around.

i actually have a hard time going through stores that sell perfume and the like. the smell makes me want to vomit as i have a very strong sense of smell

I've heard that argument for years and the reality is that the second some bars decide to allow smoking, all bars will have to follow suite just to remain competitive. Smoking is a unique vice in that it has a direct negative impact on not just you, but everyone in your immediate vicinity.

As far as I'm concerned the same rules and regulations that govern health and cleanliness in restaurants and bars should also include air quality.

Yes, we have all heard of the second hand smoke. But back to the beginning. It is the choice of the consumer. If all bars and taverns followed suit and permitted smoking, tough luck. The world does not revolve around the individual. I am one who would deal with the inconvenience, not go whining to the municipality that things aren't going my way.

Pretty much this but liberals do not like personal choice they will tell you the choice you will make in your best interest.

I didn't stop going to the bar because of the smoke (which they have banned). I stopped going because of the meth heads taking it over. They don't do meth there, but I just don't like their type. It's like racism, but with meth heads. I'm superior!
 
I don't mind those who vape. I mind the ones who vape, exhale GIANT CLOUDS of the shit, and blow it in your face. With smoke, they aim their heads up and blow it away. With vape, they just blow it anywhere.

That's because I've found that the majority of vapers are not or have not been smokers, therefore they have no etiquette at all.
