T-Mobile Paying $48M To Settle FCC Complaint

In addition to paying out $48 million for failing to properly disclose restrictions on speeds and data for “unlimited” plans, T-Mobile has also agreed to a number of other concessions including not calling plans "unlimited" that aren't unlimited.

According to the consent decree [PDF] released this morning by the FCC, the agency began investigating T-Mobile’s unlimited plans in 2015 over allegations that the company was employing a so-called “Top 3% Policy,” that throttled data speeds for the network’s heaviest users during times of congestion. This was a problem, explains the FCC, because T-Mobile was not sufficiently disclosing to customers the “data usage threshold that would trigger application of the policy,” nor did the company explain how this throttling could affect a user’s experience with T-Mobile service.
 
I hope they start slapping all of the carrier's around. Verizon badly needs a tune-up with the stuff they pull.
 
It sounds like "its ok to do, but you need to have it in the fine print" and can still call plans "unlimited" aka like verizon.

They also need to be hammered about getting their data usage system accurate. The numbers of people reporting Verizon billing them for huge data usage that wasn't theirs keeps growing weekly.

Of course, Verizon and AT&T can just bribe their way out of prosecution and lawsuits. T-mobile gets crucified because stupid people don't read the literature. This IS unlimited data without extra charges and 4G LTE connection speeds. The bandwidth just varies due to traffic. Stupid, whiney people just can't keep from persecuting others for their own stupidity.

So because they cant deliver their servicein time its ok to delay everyone.
Kinda like when two plumbers sinning up for 5000 house to redo pipe system in on the same week and then say "hey Congestion we need to delay this 6 months, but thank you for paying"

If you can't deliver the product don't freaking sell it.

I went out of town a few months ago on the assumption that I could still complete my work on the road using my unlimited data plan. My Surface Pro 3 downloaded and installed a bunch of Windows 10 updates overnight while I was sleeping and used 5+ gb of data on the first night of the trip so I was stuck on dial up speeds for the rest of the trip. Not ideal when you are a web developer constantly refreshing a page to see if your code is working as intended.

I'm actually ok with them expanding their infrastructure. Cause, you know, that's also a solution. Probably a better solution than to throttle the hogs. Cause I too wish to also be a hog.

That sucks.....I wish there was a way to turn that off....oh wait its Windows 10. oh well.....
 
I knew they were gonna get in trouble for their latest round of 'unlimited' plans......You can tell that once they put out a 'one unlimited plan for all' plan that of course they were going to throttle the hell out of it because everybody would be using as much data as they want, and it would congest the network.
 
You shouldn't be able to pay money to have the government look the other way plain and simple. If you commit the crime, you do the time.

You would think that, but, working for them, the average usage I see is around 10GB or so a month. Sure I've seen people use more, but they're few and far between. As for the accounts where they are "deprioritized", they even less likely to come across, and we can see exactly when they're being deprioritized. It really is during "peak usage" where everyone is home and on teh facebook. It also depends on the area, if they're in a market that isn't very saturated, they'll never get deprioritized.

That is a solution that they're working towards! I really hope that the spectrum auction benefits everyone.

It's like me having has a good experience with Cox Cable as my ISP. The people that get shafted are the ones running on old infrastructure the ISP doesn't want to pay to update, everyone else gets updated equipment and good service.
