Petitioning for 970 Refund

What gets to me about this whole dustup is that nVidia admitted that the 980 is just like the 970 in that it has only 3.5GB accessible by the main memory bus on the card...but everyone is fixated on the 970...;) According to nVidia, in some games the 980's performance drops ~47% after the 3.5GB boundary, and it's for exactly the same reasons the 970 drops ~50% after the 3.5GB boundary in the same games--but nobody seems to care about the 980! The 980's cost more, so you'd think people would be more upset about that. Go figure...;)

You're either pulling our chains or misinformed.

The performance drop in the 980 (and 970) was from the higher quality settings that were put in place to push the memory usage beyond 3.5GB.

The 980 accesses all eight memory modules simultaneously.
 
this is good that retailers are stepping up hopefully this will pressure nv not to pull this crap in future

and what you are missing is that the GTX 980's performance drops 47% in Battlefield 4 after turning resolution scaling up to 135%.

That is such utter horseshit. What farm did you get that pile of poop from? Evolve max out my VRAM usage on every game even at 1200P with no AA usage and I do not have any framerate drops or stuttering issues when it goes beyond the 3.5gig VRAM mark on my STRIX 980.

I was refunded the whole price for my GTX 970 from amazon. I actually put a link to the petition in the comments for returning it and said it wasn't as advertised. I was a little over 30 days out. This was my first time ever dealing with Amazon on a return and I have to say it was flawless. I sent it back with their return shipping label they sent me, and my wife was credited I want to say just a few days after I sent it back.

It was a gift from the wife to me for xmas. I turned right around and bought the Strix GTX 980 and paid the difference. Couldn't be happier with the 980. The GTX 970 worked great currently, but I plan on keeping it for probably a few years, as I did with my previous GTX 295. I would rather be safe now then run into a possible problem a year or so out.
 
Nvidia has been pulling some serious hijinx with the 3.5gb partitioning shit. Has anyone confirmed if this was overlooked or deliberate?
 
I'm tempted to call up and get a 20% refund, but is it coming from Amazon or evga/nvidia? If it's comming from Amazon I don't feel that's right (ie they got lied to as well) but if ultimately they're gonna collect from evga/nvidia, then I wouldn't have any issues with it.

Anyone know?
 
EVGA shouldn't be responsible either, it's really NVIDIA's fault so they should be the one's to pay up.
 
Didn't Kyle say here somewhere in this thread that the cost ultimately goes back to nVidia anyway?
 
Amazon have been awesome. They refunded me 20% on one of my cards with no issues. (they would not on the other)..didnt want to push it.
I also hope Amazon recoups this off Nvidia.

I'm not really sure what we're supposed to take from that rhetorical question. Does that mean EVGA or Nvidia is ultimately paying for it?

Hmm I suppose if that quote is taken out of its context it loses its meaning.

But my interpretation is that AIBs simply ask nVidia for reimbursement in these situations, so the cost goes back to nVidia in the end (and rightfully so).
 
Wrote email today to Amazon, already got answer that $65 will be credited to my account. I did not want the money refunded, as I shop Amazon weekly. Still like my Zotac 970.
 
Must be why all the 980's that are decent have been low stock on amazon. I returned my 970, got a real decent discount on a 980. Picked up a Gigabyte G1 gaming 980. Just sent the 970 G1 back.

Amazon has earned my business. Newegg, sorry. I used to defend newegg, not anymore. They were not willing to do a return for my buddy who bought his 970 there.

You clearly have no understanding of what the problem is, or how the architecture works. The 980 is not hampered by the issue at all. All of its memory modules can be accessed. So please do some homework and stop mis informing people.

Do you really think nvidia is gonna disclose that? :rolleyes: besides, they already stated it was due to a "communications error" between the engineers and the tech PR teams during the product launch until some tech head detective on another forum sniffed "too deep" and found their "mistake" and thus, this shit storm

Don't know what to do, i can get a full refund for my two 970 or a 980 with discount

the only card at that high price point is the EVGA GeForce GTX 980 Classified and i cant say its warranted

get the moneys and wait till march ?
 
The amazing thing to me is that some 970 owners say they're upset at nVIdia for lying, but then they return their 970 only to buy a 980. so you're effectively rewarding nVidia with higher profit margin because they lied to you. Why would you do that? :confused:

due to discounts , for me its about 100 bucks
without it, i wouldnt even think about getting a 980

but i will prolly just get a refund, since i dont think those Classified cards are worth it

Unfortunately there's no other reasonable choice right now. I can't go back to my GTX 260. That might be worse than getting a 290/290X. ;)
 
I just got off of Amazon chat. They refunded me 20% ($70) for my Asus Strix GTX 970.
Other's have reported success also in getting 20% refunded. Some are saying they got denied though.

I sent an email to Amazon, asking for the same 20% discount off of the purchase price of my eVGA GTX970 Superclocked (04G-P4-1972-KR), which I purchased in September 2014. I explained the issue thoroughly, talking about the segmented vRAM and the difference in the amount of L2 cache and the ROP count. I explained how this issue recently came into public awareness, and how it affects all GTX970s regardless of brand or manufacturer. I provided links to articles, and talked about the performance hit past 3.5 GB vRAM. I mentioned how retailers such as Newegg and MicroCenter are offering a 20% refund. I told them that I felt I was entitled to a 20% refund as well, pointing out how between now and launch, customers bought this GPU with the wrong specifications in mind, and that the card was falsely advertised. Customers were thus experiencing performance below what was advertised.

This is the email reply I got back:

I'm so sorry about the problem with the item. This usually doesn't happen.

I can completely understand your disappointment. That's not what we want our customers to experience. I apologize for any inconvenience caused.

Gawd damn. That's some good-ass customer service. I took the 30% discount, by the way. I wouldn't have thought to do this if it wasn't for you AjFreimuth, so thanks a ton. I didn't realize people were getting partial refunds from different retailers/e-tailers cuz of this issue.

It costs nVidia money to make the 970 chips, and also costs the ABPs money to buy those 970 chips and then even more money to manufacture the GPU. Now the distributors and retailers pay money to get stock in. When they are returned for full refund en masse, nVidia, ABPs, distributors, and retailers are losing money...regardless if a different nVidia product is selected to replace it. It's not like they are waving a magic wand and converting every returned 970 into the 980s being sold at no cost. This is not good for nVidia and everyone involved...their partners and then their partners distributors and their distributors retailers. All the lost money is going to be chain-reaction chargebacks starting with the retailers to the distributors, then the distributors to the ABPs, then ultimately the ABPs right back to nVidia.

through amazon? yeah im in the same boat with newegg store credit or nothing. I tried getting a partial refund but wouldn't go for it.

Wow, the partial refund people are getting through amazon is great, their customer service sounds excellent dealing with this issue. I wish Newegg would offer something similar if I decided to keep the cards.

I just did the same and I had my refund in less than 5 minutes. I accidentally let the chat time out but they honored 20% for mine. Wish I had saw your post first and shot for the 30%.

yep several retailers made some great PR with this

Amazon was doing refunds from the start and not after pressure from the costumers like the rest

i would never buy from a seller again who did not give me a refund after this and i sure like hell wont buy any Gigabyte cards anymore, as for Nvidia it will take a long time for them to regain my trust and my next generation will be AMD

might just tweat Roy to get me a good 295x2 deal :D

I have the same mindset. You are angry at a company for selling you a bad product, therefore you return it and buy the more expensive version?

This is clearly a luxury item market as if something like this happened in the essential market it would cause a lot bigger uproar.

No, selling the 970 privately and purchasing a new 980 would be rewarding the company.

At least with taking a discount or returning, it is forcing all companies involved to do something. At the very least, its giving statistics by purchases and returns.

Selling privately, all nvidia would see is that they sold a 970 and a 980! At least with a return they would see that a 970 was returned and a 980 purchased.
