Hey everybody, I hear the Silk Road 3.0 domain is open! It comes with bracelets, free transportation to your court appearances and room and board!

Preet Bharara, the United States Attorney for the Southern District of New York, George Venizelos, the Assistant Director-in-Charge of the New York Office of the Federal Bureau of Investigation (“FBI”), and Peter Edge, Executive Associate Director of Homeland Security Investigations (“HSI”), announced today the arrest of BLAKE BENTHALL, a/k/a “Defcon,” in connection with his operation and ownership of the Silk Road 2.0 website, a hidden website designed to enable its users to buy and sell illegal drugs and other unlawful goods and services anonymously and beyond the reach of law enforcement. BENTHALL was arrested yesterday in San Francisco, California. He will be presented later today in federal court in San Francisco before Magistrate Judge Jaqueline Scott Corley.
 
I fail to see the legal justification for this. Granted it is a site that allows illegal stuff, but if it is just nothing more than a portal to it and doesn't actually host. This seems on par with throwing people in jail because drugs are are transported in cars..on the road.

But it could be more obviously, I'm too lazy to look into it. I just naturally assume our government is breaking more rules than those they are throwing in prison at this point.
 
It is not a matter of whether the site actually hosts the illegal activity. The moment that the site began to generate millions of dollars in revenue, it became an accomplice to the illegal activity taking place.

According to the FBI's complaint, an undercover Homeland Security Investigations agent was able to infiltrate the Silk Road 2.0 support staff. The agent was therefore able to gain access to private sections of the website and communicate regularly with "Defcon."
Sucks to be BLAKE BENTHALL. 10 year mandatory sentence up to life for selling drugs, up to 15 for selling fake ids, up to 20 for money laundering...

Accessory or they may have used RICO. If I open a flea market and knowingly allow illegal activity to take place, I can be held responsible for said illegal activity. I then have to prove I didn't know, which is usually pretty hard in the Silk Road cases because they usually have a metric shit-ton of cash from operations.

I still don't understand why they operate this stuff from within the US.

First of all, note that USERS of the service aren't in jeopardy etc... its the admins. Also, the way that the service was taken down was basically social engineering, where an undercover agent managed to get invited onto the admin team and thus was able to find out personal information about the other admins etc..


All this said, its another hideous waste of resources for non-violent (mostly drug) related offenses. Hell, considering the admin of the site didn't even actually sell anything, its insane to see these charges much like the trumped up garbage on Silk Road 1.0s founder. There's no reason a person should be up for a mandatory minimum of 10 years for fuck's sake for "conspiracy to transport narcotics", simply by running a website and looking the other way.

The entire premise is flawed and part of a larger "war on drugs" clusterfuck; a guise for overreaching government power as directed by monied private interests who are truly in control. Things are made even worse when this nation uses trade agreements and threat thereof to force other nations to change laws/policies to things that suit the powerful industrial complexes that exist. Its time to put an end to this as it benefits and enriches no one but the most vile, greedy industries that have co-opted this nation.

Seriously this isn't the movies, the goberment doesn't have a magical hacker that can pound on a keyboard and in a week subvert the "scsi firewall and reroute the token tcp IDE traffic through a trace buster buster".

Yes the government are watching nodes, even putting up nodes themselves. There still have been very few if any reports of TOR being completely compromised. In every case I have looked into traditional detective work/mistakes broke the case.

Maybe there are it isn't known or reported...

As always never trust anyone or anything if you are paranoid.

I'm also all for legalization of most drugs anyway and I don't care who dislikes this opinion. They could be made somewhat safer (relative) after legalization, too. The US government literally murders people (almost?) daily yet its citizens can't try some fucking drugs like DMT or weed without being locked in a cage if caught.

Get the fuck out here with that tyrannical bullshit.

I agree that the war on drugs doesn't seem to be working, but legalizing them is going to cause even more problems.

First of all, who are you going to legalize them for? people over 21, over 18? What about 15 year olds? What about pregnant women? Do you really want doctors, bus drivers and airline pilots using hard drugs?

As much as I'm against legalization, I might be willing to consider meeting half way. How about decriminalizing it for anyone over 21, very harsh penalties for anyone selling or giving it to someone under 21, and drug testing anyone on government assistance (you test positive, and no more welfare, food stamps, etc.). If you want to ruin your life, then go ahead, just don't expect the taxpayers to support you.

The problem with this is it would also hurt any dependents. Can we please think about the children.

No it would be more like transporting drugs knowingly in your actual car. These guys knew exactly what was going on and made it the purpose of the site all while making money off of it.

Marijuana is so easy to get that I don't think this was used mainly for that. Cocaine, Heroin and the likes are not legal anywhere AFAIK and legalizing those might have a bigger effect than Marijuana. I don't care for Marijuana and am against it, but it doesn't really have a huge long term effect on people like harder drugs do.

They already were legal in the past. Doctors use to prescribe cocaine and do it themselves for a long time, it use to be in the soda Coke. Synthetic Heroin is used in hospitals, today, everyday! They give it to me before when I was in there and I'm fine. It didn't ruin my life. Also, sugar and tobacco are most addictive than cocaine, kill the most people every year, yet legal. This isn't about safety one bit. That's the propaganda to the peasants.

This is all about the government and big business controlling the drug trade. The CIA has literally been caught bringing cargo containers full of cocaine into this country all while the police arrest the people on the streets (the poor) distributing it.

Another fact, opium production has risen since the US has been in Afghanistan. I wonder why, not really.

People didn't get addicted and ruin their lives or anything, nope it was the government. There's also a huge difference between getting some form of Heroin in a hospital and just doing it to get high. Cocaine isn't used because there aren't really any medical benefits that warrant it.

It is. Tobacco kills the most people worldwide and IS more addictive than cocaine and probably similar to heroin addiction (minus the withdrawal). Yet, it's legal. Why? I guess your sacred government doesn't care that much about the people after all.

Why doesn't someone outside the US just recreate the web site? Preferably from a country with no extradition treaty with the US and on servers that US and their allies can't touch?

Seems rather foolish to do it from the US and expect not to be eventually shut down and prosecuted.

Starting off with an insult, nice. Again, snorting cocaine is the same as using controlled amounts in a small area? Everything can be abused, no denying that, but there are legit uses from some substances or variations of them. Cocaine in it's pure form doesn't really have a ton of benefits, note I said pure form not the leaves or different forms of it. Every medicine is a drug and should be treated as one, which means you only take it if you really need it. Most people can't seem to do that and need medicine for everything. Do you really want to make pure hard drugs even easier for them to get?

I was always afraid that when I'm walking around late at night that someone would inject me with a marijuana and then I would die. Thank you government for saving me from being assaulted by drugs!
