A 67-page complaint? Seriously? I don't think GTA's script was sixty seven pages long! :eek:

The actress still must confront the questionable decision to bring this lawsuit in New York — a state whose version of a publicity rights statute only concerns works of "advertising" or "trade." But her lawyers are clearly attempting to overcome that hurdle by now alleging that Take-Two Interactive has been using an image of the blond character (allegedly Lohan) on merchandise like T-shirts and coffee mugs as well as in advertising on billboards, posters, buses, buildings and websites. The lawsuit also aims to counter any talk that the game represents a transformative fair use, which would invoke the free speech protections of the First Amendment.

her claim could play into that every drug addicted loser in gta was based on her life. Or maybe she based her life on others and they can sue her for likeness rights?

I'm sure there is a blond likeness (character and all) at Take Two that the character was based on. ;-)

I hope take two wins this. they did screw up adding that song they wernt supposed to but my uneducated opinion is they don't have a snowballs chance in hell.
 
Even if the character and every illustration is 100% guaranteed based on her, she still doesn't have a case. This is stupid and in a reasonable litigation system it would have been thrown out by now.

Based on the amount of publicity this is generating Rockstar will probably feature this character heavily in the next GTA game.

Not necessarily at Take Two but not Hohan either (pic). The timing of this is perfect for TakeTwo in terms of PR value, seeing as their second milk run on GTA5 is about to commence.

I think she could win this, no seriously. The court system is this country is so abysmal. I give her a 50% shot of coming out on top with something.
 
I don't care who the model actually was and I really don't care much for Lindsay, but I hope her lawsuit is successful just because it'd be funny to hear about it.
