I did that once, but didn't smash or throw the phone. Snatched it right out of some asshole's hands. I gave it back, but made him leave.

I've thrown popcorn, pretzel bites, sour patch kid and an empty drink at jackasses who talk on their phones during the movies, but never have I tossed their phone. I've wanted too, don't get me wrong. I just don't want to pay for the thing.

Where i come from we call this type of person a Felon. Seriously, if you grabbed my phone from my hand and threw it, I guarantee you would be in handcuffs very quickly, facing felony malicious destruction of property and assault. This guy is not a hero, hes a criminal.

Not illegal to talk in theater, but you better be ready for the person who is armed that you piss off and doesn't give a fuck. Too dangerous today to not give a fuck about consequences of fucking with people property. People go batshit for lesser stuff.

I doubt it constitutes an "assault" in most states and with the dollar amount involved it would more than likely be a misdemeanor. Put you big girl panties on son. ;)

What do you mean maybe? Its a clear cut case of MDOP. Taking another person's property and maliciously destroying it. Absolutely clear crime AND tort. Im posting this because this forum has WAY too much tendency to applaud idiotic things like this and not realizing what a serious CRIME it is.

With the way laws are worded and interpreted, I could see him forcibly removing the phone from her as being robbery regardless of his intent on what to do with it. If they base it on full retail value, you are right that its over $500 if its a smartphone putting that into felony range. All depends on the lawyer involved and the court system.

On a serious note, is it really worth getting slammed on your haircut at the movies for being a disrespectful ass that talks on your phone? I am always amazed by the type of people that love to ruin shit for everyone else but then scream bloody murder when someone does something about their obnoxious behavior. :confused:

Why do people spout this stuff off, and clearly forget the OTHER side of the coin? There were NO CELL PHONES posted, and said person on their cell phone is ruining the experience for other theater-patrons. ALL OF THOSE people didn't pay the exact same price as the cell phone user to have THEIR experience lessened/ruined.

If people would quit being such dicks about it. Don't get me wrong...I love my smartphone. But I know when to put it away and have some fucking respect and be courteous to others.

Great invention, but I sometimes miss the times before they were in every pocket. They are goddamn leashes. People need to unplug and chill out for a while. It IS possible to enjoy yourself or an experience without having to Tweet, Foursquare, etc about it.
 
I had a better solution, set up a decent HT system in your house, never go to the theater again and put up with any of that, you can make house rules whatever you want. Sounds better too. Costs less in the long run.

As for laws it was certainly vandalism, but you know sometimes even though its wrong you still feel like people deserve it so long as they were asked to stop and they didn't.

What, are you going to sue the theatre because they told you to stop making noise during a performance that many many people devoted much time to?

If you want to sit in a room and fiddle with a phone, why go to a show/movie?

Though, if they damaged the phone, I think they should be liable as well.
 
If you successfully grab the phone, might be worth taking a quick walk to an usher and explain "person x over there won't stop using this, could you please hold this or give it to a manager to return it to them at the end of the show?"
 
I know that posting this assures a string a bad experiences. But I've yet to see a person in a movie theater being rude with their cell phone. I must be the luckiest SOB on the planet...

Is it really worth getting slammed on your haircut at the movies over stealing someones cell phone? Step up, tell a theater employee there is a disruptive customer, and let them deal with it. What if someone gets really pissed about it and decides to press charges? You're gonna have a hard time convincing a theater full of witnesses to pretend they saw nothing and lie to the police.

If you use violence or force to take someones property, that's class B felony Robbery in WA state. Now, obviously no prosecutor is going to charge someone with felony robbery over grabbing someones phone out of their hand, but it's probably gonna put something on your criminal record.

There's an adult way to handle things that doesn't risk life, limb, or a criminal record. Why not use it?
 
IMHO it's the managers job to get rid of the disruption. From the article it looks like this person tried but nothing was being done. I personally wouldn't have left it there. I would of asked the manager again, and if nothing was done again, from the article they had security. I would of just asked them to do something, if nothing was still done I would of demanded a refund, the reasons are very straight forward and I can't see why they wouldn't honor it, either that it would bring enough attention to the issue to invoke some kind of action by them. I can be a stubborn person too if ethically I feel I am in the right.I know all of this would of taken a while to go through but its the cleanest/safest/logical way to do it. You can call it being a coward but if you ask once, ask twice and get a jackass response. I am not going to physically do something TO you but I will have something done about it.

NO ONE is advocating violence. Period. In fact, we are simply stating that there are people in this world that will whip someone's ass for being a disrespectful and some of those people with a propensity for violence even carry bail money on them...just in case.

Now, we ARE laughing our asses off at that lady, maybe she'll think twice about ruining everyone's evening because she's inconsiderate.
 
I would love to toss someones phone like that if i grabbed it and they had a protective case on it i would see how protective it really would be. I dont like to even go to the theaters with one of my friends because he messes with his damn phone during the movie.

Spire is probably correct in this(depending on the state). It is generally better(in most states) just to punch someone in the mouth when they talk on the phone in the movie theater. It's only a misdemeanor.;)

You can kick their ass, just don't get all ghetto crazy and seriously injure them or it will turn in to a Felony again. Keep in mind you can be held accountable civilly for all of the above.

This was a live performance not a movie and probably costs way more than a movie ticket to attend from my understanding.
 
I suppose people in west michigan are a lot more respectful. I probably goto the movies 6 times a year and have never had someone talking on their phone or texting -- at least not that i remember or noticed.

Im a little torn on it, i would hate to leave the movie to complain about a cell phone user -- asking for a refund ? without having proof someone was being a jerk ?

We have yet to determine the value of the phone but either way the law will vary state to state and I doubt he is going to serve time or be charged with a felony over a tossed cell phone. I'll keep being a moron and you keep be an ahole.

thats as awesome of an idea as the head of the DOT suggesting that cell phones shouldnt work when moving faster than 5 mph

how could that EVER backfire, since no one has ever needed a cell phone to work in a movie theater :rolleyes:
