After dealing with RAGE, Sim City (5), & A:CM; pre-ordering shouldn't be so painful if you know what to avoid. Sadly, it's not as simple as I'd wish it would be when discerning what not to buy with AAA title games.

So developers are allowed to show whatever crap they want and then sell something else to consumers? This was not a case of content getting cut or rearranged for the sake of demo which the "not representing final product" is usually about, the E3 "gameplay footage" and the game released had nothing to do with each other and consumers had no way of knowing this before game was released and review embargos were lift.

Otherwise I agree. I havent preordered a thing since Mass Effect 3. (which was mandatory purchase anyway, preorder or no) Preordering should stop and developers should earn the money with great games, not with how many people they can fool with hype machines.

people should definitely be selective when pre-ordering games...but the thing with Colonial Marines was that most early previews were saying the game did not seem that great...it had mostly negative early buzz which is what caused me not to pre-order...so the people who ignored all of this have only themselves to blame...they wanted the game to be good so they convinced themselves that everyone else was wrong

the lawsuit will go nowhere...it's just a way of generating more press for how badly the game was botched...if Gearbox ends up losing the case then it will set a bad precedent for all future games where developers decide it's better not to make games at all

i disagree. it will make developers think twice before putting out demos or screenshots that are not of true game play.

Yup. It IS frivolous and won't go anywhere however it definitely has gotten some attention and sent a message like you said and I think that's good.

Fine with me. I also don't buy a car based on concept models, buy a product based on a commercial, or judge a movie based on a trailer. I see no difference here really.

This is your responsibility, not theirs. IMO the trigger-happy consumer mentality is a wide-spread problem. Trying to pass a law to curb these urges is extremely unrealistic, not only technically but also politically. Maybe if money and lobbyists were not so rampant it might be possible, but IMO the better place to start is with YOU. You have control over what you purchase, right? Try to practice that a bit more often. Everyone including yourself will be better off.

New patch came out. More graphical improvements along with more AI improvements.

There was no mention of AI improvements that I can see. Then again there was no changelog so other than adding SSAO we have no idea what they did.

It was mentioned by fellow gamers that tested out the new patch. Ultimate badass is actually harder.

Yeah but what if said car manufacturer advertised his new upcoming by using the concept car in their ads, and being tightlipped about the changes and finally when customers get their product it turns out to be something completely different than what they were shown and told? Only after the car gets released they add the text to their adds that it doesnt represent accurately the product it advertises.

You just dont do that, and its against the law. False advertising. Thats what this lawsuit is about, to see if Gearbox has really broken any laws or if this is all just one big case of wrong expectations by consumers.
 
lil necro here.. but this was 5 bux on steam so I bit... wow this game is bad. It's fun to laugh at how bad it is though.. kinda. with the highest in game settings it still looks like crap... reminds me of DNF kind of... all washed out and grainy... that's with film grain disabled. not to mention the game play.. lol. AVP is soo much better... heck even Doom3 with mods is way better. The only redeeming thing is being set in the aliens universe and being able to be on the Sulaco and stuff.. but sooo poorly implemented.
 
After looking through the Steam community thread on this and seeing that 99% of people said not to get it, I decided I had to have it just to see what all the fuss is about.

I got DNF for $5 on Steam and actually rather enjoyed my playthrough. I got Colonial Marines out of morbid curiosity to see what I'll think of it. Wish me luck, hah!
 
That's kind of why I got it... I'm going to try and play some more tonight..
 
I've played it for about 2 hours now. As far as I'm concerned, I got my $5 worth out of it. It's no game of the year contender, but it's not that bad if you go in expecting a few hours of arcade-style shooting. The visuals and especially the audio are actually pretty decent and deliver a passable sci-fi immersion.

It's so funny to see how these impact how a game is reviewed/judged/perceived.

1) Expectations

I don't know much about the Aliens franchise. I watched the first one, and I really didn't care for the movie. My wife and brother watched it with me. None of us "got" it, sorry. I guess you just "had to be there" in '79. I had no hopes and dreams for this game based on a love for the movies. I guess that works in favor of the game in my case.

2) What others think

It's cool to hate this game, period. No one wants to stick out by disagreeing. It's not a great game. It's not a steaming pile of poop, either.

3) "Peer" games

Read the steam thread on this game. Everyone pretty much agrees that this game isn't worth even $5. Yet we're all happy to plop down $10-15 for re-releases of Duke Nukem 3D or Shadow Warrior (I bought both). After playing a bit of those games, and after the nostalgia factor wore off, I realized that we've gotten a lot better at making video games in the past 20 years. Colonial Marines is no Bioshock Infinite, but I think it's more fun than Duke 3D!

Edit: Don't get me wrong, I would not have recommended this game to anyone for $60.

It's definitely worth $5 if you're at all a fan of the series. Not worth much more than that, since the MP is dead (AFAIK).
 
More than anything else, I think this is a bad game because it's an ALIENS game where you spend most of your time fighting other people/robots.
 
what they got right, the sounds of the weapons and aliens... right out of the movie!

Last year a class action lawsuit was filed against Gearbox and Sega alleging that Aliens: Colonial Marines was falsely advertised as its impressive press demo at E3 didn't resemble the final retail release...At the time Gearbox and Sega sought to fight this lawsuit and now Gearbox has filed a motion stating exactly why the accusations are baseless and that the developer should be removed from the lawsuit entirely

One of the most interesting reasons is that Gearbox claimed that it sunk millions of dollars of its own capital into the game's development...

Wow, I didn't realize the lawsuit was still going on. Good times. In my mind it seems like Gearbox has a HUGE amount of blame in what happened to A:CM.
 
fucking randy, someone should cut his leg off with a sandblaster and sear the wound with a fucking clothes iron then tie him up like a salami and beat him up with his own leg THEN put him and his leg inside the usual cloth sack and dump him in front of a hospital, let them sort him out, heheh! :D :D :D
 
I hope Gearbox is sued out of existence.

It's really split around here, but personally I took the beer goggles off after getting burned so hard on ACM. It can not be called a functional game in any way shape or form. I could easily compare it to early access unfinished budget titles I've gotten more out of on steam.

If you just sit down and think about it ok Borderlands was good. Infact I really did enjoy it despite it's MAJOR faults on PC. Yeah they made a couple DLCs that were ok as far as DLC goes.

They lied up the ass about Duke Nukem which would have turned out much better if they had admitted from the get go that 3D really had finished 70% of the work and they were just the clean up crew.

Ok they made Borderlands 2. Me personally I wasn't impressed. It just bored me. It didn't feel new it was just more borderlands. Worse they couldn't think of any where to go with classes so they got lazy and just hampered the skill upgrades.

Besides that I mean why are we treating them like Bungie or the original Infinity ward or DICE? They've done 0 to earn any kind of credibility. Honestly I don't know that the studio should be axed they seem like good people, but what Randy Pitchford did with ACM would be considered in any other industry fraud. He should should eat the returns out of pocket and step down. If Sega wins this lawsuit it's the Devs that are going to get hurt and this isn't their fault.

Why is it that Sales engineers always reap the rewards and regular engineers always take the blame?

It’s your lucky day (and mine)! I loved BL2 much more over the original. I had fun playing BL1 but only with my wife. Solo felt like a chore. BL2 I found the characters much more entertaining. Greatly improved story. Handsome Jack is a great villain. It was improved in every way just like a sequel should be.

There wasn't really a whole lot of innovation going on, and from what I see of the "pre-sequel" I don't see much innovation there, either. I don't know that Gearbox has as big of a hand in the pre-sequel as they did in BL1/2, but their name is still on it.

I guess I didn't expect innovation in the second title. More of the same, but better in almost every way was good enough for me :p

Now, I never thought of the Borderlands games as instant classics or top tier games, but they did deliver on what was promised.

On it's own it would have been great I think just after having put in so many hours into the first I couldn't get into it.
 
I haven't played ACM but I have been a Geatbox fan since the original Brothers In Arms. I can forgive DNF...but everything I've read about ACM seems pretty serious.

I love Borderlands and can't wait until a Borderworlds is released :D

Which is a bit ironic because SEGA was the one who had their money stolen by Gearbox to develop Borderlands 2.

Not that SEGA managed the project that well, though.
 
So where do we go to get money from this? I'd certainly like to get my money back for this crap.

As usual though, lawyers will get a huge chunk and customers who paid out full price of the game probably won't even get 5 bucks.

If approved by the court, Sega will pay $1.25 million into a settlement fund...Of that fund, $312,500 will be used to cover attorney fees for the plaintiffs, $200,000 will be used to cover the cost of adminstration, $2,500 will go to the plaintiff and the rest will be used to pay to those eligible customers who purchased the game...Payments to customers who fill out a three question claim form, purchased the game before Feb. 13, 2013 and are approved, will not exceed the amount paid for the game...The amount each customer receives back will be dependent on how many people submit claims
 
That leaves 735,000 bucks to be divided out to the customers.

735,000 / 60 bucks (is that how much it costs) = 12,250 customers who get a full refund

I have a feeling that many customers won't bother making a claim. So, if that is the case, where will the left-over money go to?
