The National Pork Board isn’t too happy with ThinkGeek’s canned unicorn meat. It seems that using the phrase “the other white meat” in conjunction with fake ads for canned unicorn meat was enough to get the lawyers fired up enough to send cease and desist letters.

"It was never our intention to cause a national crisis and misguide American citizens regarding the differences between the pig and the unicorn," said Scott Kauffman, President and CEO of Geeknet. "In fact, ThinkGeek's canned unicorn meat is sparkly, a bit red, and not approved by any government entity."
 
Parody is protected by the first Amendment. Sleazy lawyers harassing people with stupid cease and desist orders should be crime.

The cease & desist letter is ludicrous. The Pork Board is up in arms because other websites referred to it as "The Other White Meat". ThinkGeek did not use those words.

From what the first page of their C&D letter I believe they are concerned of other sites (they mention a facebook one) using the trademarked "the other white meat". The claim is the canned unicorn meat as "the new white meat" cuts awfully close to their trademark.

Sure.. probably a boring legal afternoon but if you don't defend your trademark you lose it.

All I can say are the Food Laws from what I've seen/read are a PITA, ask Oprah.

However its not Unicorn meat you need to watch out for, its Magical Unicorn Mayonnaise. (which I used to make these sandwiches)
 
Props to ThinkGeek for using their C&D response for marketing. They took pork lemons and made some capitalist lemonade. DeLICIOUSly savvy. Everyone wins here. People aren't going to stop eating pork because these lawyers were silly dicks - bacon is too good. And ThinkGeek gets some free press.

Isn't something like this covered by 'Fair Use'? It was a joke. If I wanted to take the pork slogan as my adult film star name, could I be sued for trying to sell my laughable DVD's?
