Activating a new phone - Does the protection plan of the old phone still apply?

My Instinct broke a few days back (touch screen stopped responding). I have a Best Buy protection plan that I'm making monthly payments on. I don't have the paperwork at the moment (my mom has it lying around somewhere), but I know I have it.

I just got a Pre in the mail today. I want to activate it, but I want to be sure that the protection plan on my instinct still applies. In other words, does a protection plan apply to a phone without service? As long as I'm making the monthly payments I should be good to go, service or not, right? Obviously this is some kind of electrical failure that has nothing to do with having service or not.

Please confirm ASAP whether or not it's safe to activate the Pre before getting my Instinct fixed/replaced by Best Buy! Thanks guys. :)
 
I'm not familiar with Best Buy's protection plan or their policies, but the safest bet would be to submit the claim on your Instinct before switching to the Pre.

It does cover the phone even if it isn't active. It has nothing to do with the provider with the protection plan. When you do the claim they will deactivate the phone to put whatever phone you would like or a loner phone that you put a 150 deposit on. But in your case you can use the pre.
