It is sad that bills like this are even needed to prevent the misuse of non-disparagement clauses. :(

A bill that would enact a nationwide ban on the use of tricky “non-disparagement” or “gag” clauses to prevent consumers from providing their honest opinions in public forums is one step closer to becoming a law today, after the Senate Commerce Committee voted to approve the Consumer Review Freedom Act.
 
Such a measure could be great, but at the same time there should be a provision to prevent primadonas from starting crap with a business, that either didn't do anything wrong but fell short of pleasing said primadonas, or while they fell short, they tried to remediate the problem, but the primadonas felt slighted.
 
And it will probably state, or leave a gaping hole, that you can still be sued over the review.

Thus making the entire thing a drill in useless legislation and a waste of money.

Existing laws against libel would be on the side of the business, in that case.
