I am actually surprised the number of lawsuits isn't higher than this.

There’s no ifs ands or buts about it — the fallout from the recent massive data breach at Home Depot is far from over. The company wrote in a filing today that it’s got the specter of state and federal investigations looming over it as well as at least 44 civil lawsuits in the U.S. and Canada.
 
Hmm. That explains why I lost over $400 today in value from my 250 shares. No worries I purchased the stock when it was $22.68.
 
so have those who perpetrated the crime been caught? Or is Home Depot the target because they are the easier and richer target? IT 101. There is no such thing as perfect IT security. Any system can be hacked. So Home Depot has been branded as the scapegoat.
 
It's about time people start going after these companies. They are ultimately responsible.
 
On the flip side, IT security specialists are highly valued in the job market.

While it is true that "there is no such thing as perfect IT security", Home Depot may still be held liable if they did not take adequate measures to reasonably secure the information. In order to accept/process credit cards and credit applications, you have to meet certain industry standard guidelines (i.e. PCI compliance) and part of meeting these standards includes making demonstrable efforts to secure customer information. This may or may not be difficult to prove, depending on the circumstances, but if Home Depot did not take sufficient precautions, then they opened the doors for a lawsuit. If they did prepare appropriately, then the hackers got lucky.

Home Depot may still settle out of court simply to avoid the legal fees and PR nightmare though...
 
"Commercially reasonable" will be the key phrase the lawyers will be arguing back and forth over.
 
Sounds like a good deal going there for the govt. They set up PCI-compliance laws so they can fine the companies that get hacked.

if they had done basic stuff like buying a £100 Smart/Managed switch for each store and 2 dedicated broadband connections and Separated the POS network from the general network this would of not happened (VLAN)

the access happened due to HAVC contractor VPN access got compromised to get inside the network to normally access the heating and cooling but as the POS system was not VLAN'ed they had access to the servers and the POS systems once they dropped an file on the server that updated All the POS systems to act as skimmers for SWIPED cards as they captured the mag strip in the system ram before it was erased (not sure if they had chip and pin at the time quite sure they did not not that is matters as no Big banks in the USA issues Chip and pin cards)

o and on top of that they ignored that there network was possibly compromised form some endpoint network monitoring software (they had some sort of network monitoring they was notified months before it was well when o S we got an problem but ignored it lol)
 
For fun, go to a store and ask them about this. I was making chit-chat with a cashier. Had never even heard about the breach. I wasn't really too surprised.

Even more fun, ask anyone in the store about the Wink Hub they sell. It's comical. (Again, not expecting much from a place like this. My question was about a printed coupon - it took 3 cashiers and an asst mgr to figure out the just scan the bar code.)
 
I joked with a cashier as I was checking out using a credit card. "hopefully I don't get hacked!". We then chit chatted a bit about the whole thing, she was aware of it but not really more than that.

Supposedly the breach that happened did not affect chip cards though. So it's only really people with old credit cards that would have been at risk. I don't think they even give out non chip cards these days or can you ask for it?
 
I used me card at home depot on 11/10. On 11/12 I received a charge for $207 at some place called BJ wholesale in New York. I am in Hawaii and haven't been off island in many months.

My bank actually caught it before I did. They called me a day or two after the charge to ask me about it. They said someone used a physical card that was swiped. The bank deactivated the number and issued me a new card. A dispute is currently underway.

Was this from the home depot breach? I don't know but it's the first time it has ever happened to me.

How could it have affected cards with chips at Home Depot? Home Depot isn't set up to take chip cards yet. The card readers have the slot for chip cards, but they don't work yet. They are supposed to be activated in early 2015.

The only retailer I have been able to use a card with a chip is Walmart. A number of other retailers have slots for chip cards, but they don't work yet. Target has the slot for chip cards, but the slot is covered up by a plastic filler.

Huh? I use chip card at Home Depot (and everywhere else) all the time. I don't even think you can use magnetic strip unless chip fails a few times.
