In Manhattan court papers made public Tuesday, Take-Two Interactive Software Inc. and subsidiary Rockstar Games call the case frivolous and maintain it was "filed for publicity purposes." They want it dismissed and want the "Mean Girls" star to pay their legal fees.
 
"If she doesn't have the money to pay the legal fees she will be required to play a voice role in the next expansion" I think they should add this!

I am thinking she can be a playable character with story line.

I've a better idea..instead of giving her fame she doesn't need how about if she can't pay she goes to jail like the rest of us? Preferably jail in another state that isn't going to release her in 12 hours on a 12 month sentence and call it time served.
 
Our legal system needs a better barrier to stop frivilous lawsuits before they even begin. No more "pay my legal fees" we just need a better burden of proof to start with.
 
Well when they call her an attention whore I'm pretty sure they're at least half right......

Unfortunately, the trial process is meant to determine the validity of any provided evidence, so just presenting the case creates a huge amount of work in the court system. If the providing the burden of proof was required before anything went to trial then theres almost no point for the court system. Adding any barrier to entry, no matter how low, is just going to hurt the small parties more than anyone else.
 
Stupid lawsuit. Rock star has the capital to burry Lohan in litigation. Unless her lawyer works for win-only-pays situations, they can draw this out and rack her up quite a bill.

Agreed. Im not smart enough to know what the answer is though. "Loser pays" is about the best thing I can come up with but I agree that there has to be something that can be done to slim these down. From bullshit like this to Jesse Ventura to the infamous McDonalds "hot coffee" lawsuit many moons ago.

I would disagree. The whole process is designed to work against smaller parties or the whole patent troll thing would have never began in the first place.

The real issue is that our legal system is borderline corrupted beyond repair. I think it's still salvageable but every day it seems to be getting further and further from being fair and just.

In either case I don't think it's the system itself that is broken, but the cost of legal representation. The reason why patent trolling is so prevalent is because the people and businesses the trolls go after often do not have the financial means to defend themselves. If the defendants can actually bring the case to trial the trolls are exposed as their case never has a leg to stand on because they could never meet the burden of proof. The cost of entry and the time required to defend yourself means a private settlement looks more convenient and appealing to your longterm business.

OT, Lindsay Lohan isn't too smart to begin with. The fact she went after a company like 2K reinforces that point. Her lawyer should have prevented this case from going this far, but I'm sure all he/she saw at the time was the dollar signs of a potential payout from suing such a big company.
