Porn Service Sues Amazon Over 'FireTV' Name

When Amazon picked the new name for FireTV, the company knew it was going to be hot, but didn’t figure on being steamy also. The name is also identified with a porn video streaming service (FyreTV) out of Florida and the company is suing Amazon for damages. :eek:

‘Amazon’s continued use of the Fire TV moniker has caused, and will continue to cause, serious irreparable harm to WREAL’s established business, necessitating this action.’
 
Are they retarded? Fire vs Fyre, neither is ever going to be confused with the other.
 
I wonder now: How many FireTV units were sold to people who thought that FyreTV finally offered them a porn streaming device for the living room?
 
If they were smart, they would have trademarked both names. Then they would have had a leg to stand on.
 
I think they have a case. Amazon will probably settle.
 
Always amazes me when large companies don't bother to check before they start using a name.

"Who owns the domain? A porn distributor? let's use it anyway..."
 
Porn or not, this is an existing video streaming service that has an identical sounding name.

This is no different than Denon suing a competing audio equipment manufacturer using the name Dennon.
If they were smart, they would have trademarked both names. Then they would have had a leg to stand on.

Sounds like Amazon done screwed the pooch (perhaps like the actors on FyreTV?). They'll either have to change the name or pay to keep it. I expect Amazon will be kicking the crap out of their trademark/copyright lawyers over it.
 
"Wreal" and "Fyre", are these people 10 years old?

FyreTV is the name of the streaming service. The device that they sell is called the Fyre BoXXX. Seems like apples and oranges to me since they're comparing a service to a physical device.
 
I don't understand why Amazon went with the whole "Fire" branding anyway. Seems awfully unimaginative for a visionary.
 
I had no idea there was a dedicated pron streaming device. I can't believe Amazon was unable to figure this out since www.firetv.com is a registered website for said company. I'm sure Amazon is going to settle for an undisclosed amount rather than change over the branding.

Although I'm not sure why Amazon would want a device that sounds similar to a pron streaming device. The publicity and increased sales the fyre tv is going to get from the lawsuit will probably be more than the settlement.

Not necessary. The phonic sound is covered if it is within the same market space.

It's the reason you can't have a phone company with "APP-L" as the name. Or why MikeRoweSoft didn't fly.
 
I thought Fyre made shoes and boots, and had been in business long before the internet? So they should sue the porno place, who's suing Amazon, to get the really big bucks.

They sound the same in conversation. THey are both marks in the business of streaming video. They have a reasonable case to make for dilution of their mark. Amazon's lawyers should have warned them of this. I'd say they probably were warned of it and decided to do it anyway, but lately I've seen a number of business areas where you pay for a service and the people seem to do nothing but cash the check and make something up. TRademark searches is one of those areas.
 
I'm not sure they'll settle. One thing to take into consideration is the prudishness of our government. And we've always had several sets of standards, particularly when it comes to laws. I doubt the porn industry is as privileged as Amazon.
 
sounds like nothing but a publicity stunt. now more people will know the name FyreTV b/c of this lawsuit.
 
I absolutely agree. I think the porn people found the golden egg laying goose here. Amazon definitely will want to keep the name, and will just want this out of the way as quickly as possible. So they found a cash payout and free publicity at Amazon's expense. Win win.

I think they have a case. Amazon will probably settle.

The people at Amazon are not issues. They probably knew of FyreTV when they started marketing FireTV, but did an analysis showing the legal costs would likely be lower than the value of maintaining the Fire brand for the Kindle Fire in the TV space.

It was probably listed as a risk. The pr0n company might sue, and there might be some costs, or they might be too scared to take on a giant like Amazon in court.

I'm pretty sure this was all calculated beforehand.
 
Porn is an actual business? I thought people did that stuff for the shiz and giggles. Man, I'm out of sync with the times.
