YouTube Defeats Viacom Copyright Lawsuit Again

As you might imagine, Viacom isn't too happy with today's verdict. Chad Hurley's tweet to Viacom's CEO is just insult to injury. :)

"The burden of showing that YouTube knew or was aware of the specific infringements of the works in suit cannot be shifted to YouTube to disprove," he wrote. "Congress has determined that the burden of identifying what must be taken down is to be on the copyright owner, a determination which has proven practicable in practice."
 
"This ruling ignores the opinions of the higher courts and completely disregards the rights of creative artists," Viacom said.

It's not like YouTube/Google isn't trying, it's just Viacom wants them to do ALL of the work at all of the cost. The judge rightfully decided that was impractical.

It'd be one thing if YouTube refused to remove flagged copyright-protected material. They're just asking the content creators do their part and flag it.

Yep, they think submitting takedown requests is beneath them so what they really want is to be able to submit a blacklist of no-no keywords that aren't allowed on youtube. There really is no in-between. And its not Google's job to be the copyright police for them.
