UK Court Orders Apple to Pay Samsung's Legal Fees

The British court has once again proven they have no tolerance for tomfoolery or sarcastic apologies from Apple. In light of all of the problems Apple has caused concerning the court order to make an apology to Samsung, the court has ordered Apple to pay all legal fees associated with the lawsuit.

The judgement, intended to humiliate Apple, will require the company to pay for all expenses associated with Samsung's legal defense, with any disputes over the exact amount likely to be resolved in the latter firm's favor.

It's a thin line. If people get too fed up, the problem will become actual patent infringement being unprosecutable. That would be a big blow to R&D across the technology industry.

after reading the article again, it appears this would of happened anyways as UK courts typically do this.

Apple definitely seems to be crossing the line repeatedly and trying to out lawyer the courts in the UK.

What will continue to be interesting is that the UK courts are pissed off with Apple because they are continually interested in trying cases in Germany, which has jurisdiction over the entire EU. The UK courts feel undermined and maybe even insecure? Apple's first notice was really designed to tweak the judge and try and convince the public that the UK court is out of step with the rest of the world.

It's kind of funny to read the UK judgments and imagine them in powdered wigs. This latest order seriously has the judge quoting his own father, who was presumably also a judge.

Then blame the patent trolls, like Apple, not the courts.

So long as patents are allowed for lame crap such as a rectangle, or a touch screen being integrated to a phone (after it's been done before...The Handspring visor was likely the first "Smartphone" when used in conjunction with the Cellphone module), then we'll have issues like this. Unethical dillweeds ruin it for everyone.

Being able to patent the obvious, unavoidable and natural implementation of existing technology is as much to blame as the frivolous lawsuits. If Apple had owned a wooden cart wheel patent they probably would have sued Ford for Patent infringement for using a wheel with spokes.

I don't know how common it is in the US, but it's pretty common in Australia for the loser to have to pay the winner's fees. Big companies still use it to fuck over the little guy, my family took a broking firm to court and if we'd lost, we'd have lost everything because there was no way we could afford to pay their legal fees. Luckily we won, and they had to pay our legal fees, but then they still argue over every single dollar, fucking lawyers, we were still out of pocket quite a bit (not as much as if we'd not pursued them at all, though it's hard to say the stress and loss of time was worth what we got out of them).

I'm good with it. Hopefully some really expensive lawyers were involved.

Seems like a very logical thing to me. If you are going to take someone else to court, then you need to be responsible for all the cost involve if you lose.

It may get to the point that they need to pass the litmus of a pretrial to see if it's worthy of an actual trial, or if it's just another case of the trolls. Or something along those lines.

Apple should seriously get a cup of harden the fk up, from all these so called competing companies and stop suing everyone.

but that would mean the richer company would be in a better position to sue anyone. All a bigger company would have to do was hire a bunch of expensive lawyers and the small company would either face possible bankruptcy or let them get away with whatever. For the big company it isn't really a risk.

That is why the defendant shouldn't have to pay the plaintiff's court costs.

And for the defendant's court costs to be paid by the plaintiff, the lawsuit should be ruled frivilious.

Simple fix for a huge problem.

The whole patent system needs to be overhauled from the ground up as well. The people who grant the patents should have expertise in the field for which thay are granting a patent.
