From the Inq (http://www.theinquirer.net/?article=17445)

Not a fan of Creative or EAX, but thought it newsworthy.

This is called blackmail (http://slashdot.org/article.pl?sid=04/07/28/1529222) in some circles. I am going to sell my Audigy2 ZS and buy some non-creative card because of this.

Creative bought A3d out.

Creative has a patent on the algorithm used to create shadow volumes in doom3, and conviently waited for doom3 to go gold and be mass produced before telling id that they want royalties. They came to an agreement through forcing eax into future doom3 license's. (RTCW2, Quake4, maybe doom3 through a point release)

So if you didnt hate creative before, you have a reason now.

Not only that, but the patent is false. There is Prior Art involved.

Fuckers.

No more will I ever consider buying their cards. Never again.

The guys at Beyond3D and other developers posting there have outlined numerous legal precidents for fighting Creative on the basis that this algorithym was already public knowledge and had been presented before Creative patented it.

So why would id crumble to Creative if they had legal right to use the code? id doesn't strike me as the kind of company to back down from someone legally threatening them for using a design that Deitrich has already presented publicly, and Carmack had refined to a working point for Doom3.

A reply from Carmack says that id caved to help the gamers, but isn't this going to hurt in the long run?

I think we are missing some pieces of the story here...

Damn Creative, damn them to hell. I wish their was a viable competitor. I wish M-audio had some hardware acceleration on their cards. I wish nvidia would put their sound chip on a card. I wish Hercules would put out a new design, or TB.

bah!

1. Time. Game would have been delayed, for MONTHS. Legal battles take time. Look at Infinium Labs vs. HardOCP. You want Doom3 this august, or next?
2. Legal battles are a pain in the butt and cost a LOT of money.
3. Someone else can fight it later on, win, and make the agreement null and void.
4. 'cause Creative can tie this up forever in red tape.

Hard to comprehend how someone would stoop low enough to wait till the game is about to ship to spring out of nowhere :/

Yeah, it's a pretty low blow.

Thank God for lawyers. It makes the earth worms proud that they aren't the lowest form of life.

Yea, I'd rank parasitic insects a little lower on the totem pole, but just slightly higher than the average lawyer. Don't know if you saw it, but a woman sued, and won, against a man who donated sperm to have her artificially inseminated. Now, he has to pay 1500$ a month for 18 years... sounds fair to me

Also, wonderful to see Creative hard at work, making better sound cards for us all... They might turn out like SCO, just suing to earn their money. At least that way, they don't have to worry about all that expensive R&D.

Probably nothing, Audigy owners may be able to play a future version of Doom 3 with hard DirectSound3D/EAX enhancements and the Doom 3 engine should have native support for DirectSound3D/EAX.

It pretty much means that future doom 3 engine based games will support EAX.
